If future complaints are received regarding the extended construction hours, <br />the Planning Director may modify or revoke the extended construction hours. Sunol <br />Boulevard street construction hours would be limited to 8:00 a.m. to 5:00 p.m., Monday <br />through Friday, unless otherwise approved by the City Public Works Department. <br /> <br />Mr. Swift presented the staff report, describing the proposal for modifying the construction <br />hours. He noted that due to the time that the City's plan approval process has taken, the <br />applicant is behind its construction schedule, and, therefore, has submitted an application to <br />extend the construction hours. Mr. Swift advised that staff supports the modification to the work <br />hours. <br /> <br />THE PUBLIC HEARING WAS OPENED <br /> <br />COMMENTS FROM THE APPLICANT <br /> <br />Rick Sage, 6001 Sunol Blvd, represented the applicant. He advised that they are requesting the <br />extended construction hours because they had envisioned that the permit approval process would <br />have been quicker than it actually was. He further advised that because of numerous factors, they <br />did not receive all of the permits that they had hoped for as soon as anticipated. He noted that <br />they have the permits in hand now, and they want to be able to maximize the good weather <br />associated with this time of year and minimize the impact on some activities that are not <br />performed as well during the winter months. He noted that they are the owner and occupant of <br />these buildings, and they want to be a good neighbor. He reported that they established a <br />neighborhood information line when they commenced the project and he recently sent out a letter <br />to the immediate neighbors reminding them of the existence of that line. He noted that, to date, <br />they have not received a single call of concern on that number. He advised that as suggested by <br />the Planning staff, he sent a letter to the neighbors informing them of the request for additional <br />construction hours and providing telephone contact numbers. (Mr. Sage provided copies of that <br />letter for the Commission.) He commented on the work that has taken place on the site, noting <br />that they have not received complaints. Mr. Sage advised that their request was for the <br />opportunity to work from 7:00 a.m. until 7:00 p.m. and staffs recommendation is from 7:00 a.m. <br />until 6:00 p.m., Monday through Friday. He asked that the Planning Commission consider <br />Applied Biosystems' request, with the understanding that all of the other conditions are <br />applicable, and should staff assess that the additional hour cannot be supported, then they would <br />accept that. He noted that the additional time would not be for 100% of the work crews, but <br />would probably only be used by one or two subcontractors that would work the overtime hours <br />on a given day. <br /> <br />Pablo Daroux, of Wilson, Ihrig & Associates, Inc., advised that they completed a study of the <br />potential noise impacts on the neighbors of extending the construction hours. He referred to the <br />report and provided comments on the results.
