i

1. That the development be substantially as shown on the
development plan, Exhibit A, on file with the Planning
Departmellt.

2. Th~tt the developers shall retain the 48.3 ft., 36 in.
diameter walnut tree immediately northwest of the northwest
corner of the Bottini property.

3. That the developer shall employ all measures necessary to
preserve the health of all existing.trees shown on the
development plan to be retained during construction of the
proposed project. Such measures shall include but not
r~ecessarily be limited to providing barricades around the
trees to protect their trunks, roots and low hanging
branches. These barricades shall be set far enough from the
trees to protect them from soil compaction and excavation-

4- That prior to issuance of a building permit, the developer
shall prepare an acoustical analysis of all units in the
project to determine the construction methods necessary to
maintain an interior noise level of no grea~er than 45 dBA
Ldn. The analysis shall be based upon future projected
train traffic on the bordering railroad tracks. These
construction techniques shall be included as part of'the
building plan submittal.

5. That an 8 ft. high masonry (or other material acceptable to
the Planning Director) wall shall be constructed along the
entire length of the northern property line of the subject
property to shield users of the tot lot from railroad noise.
A similar wall shall be constructed along the western
property line from the picnic area to the northern property
line and along the entire length of the eastern property
line which borders the Madden property. In these two areas
the height of the wall may be reduced to 6 ft. if noise
attenuation is sufficient.

6. That the developer dedicate to the City for street
right-of-way purposes a 9 ft. wide parcel of land across the
Stanley Boulevard frontage of the development-

7. That if, in the opinion of the City Engineer, it proves to
be impractical to construct the Stanley Boulevard street
frontage improvements without constructing the improvements
on one or both adjacent lots, Standard Condition number 29
(deferred improvement agreement) may be required instead of
condition number 28.

8. The precise location of the drlveway approach onto Stanley
Boulevard shall be subject to final design.

9. That the developer file and process'a tentative tract map
for this development. The PUD site .development plan will be
subject to possible change, at that time, with respect to
