<br />r- <br /> <br />6. <br /> <br />PUBLIC HEARINGS AND OTHER MATTERS <br /> <br />a. PAP-26. Robert Grove (PDR-73IPV-60, Allen Roberts) <br />Appeal of the Zoning Administrator's approval of an application for design review <br />approval to construct an approximately 6,400-square-foot stepped-pad home, and for a <br />variance from the Municipal Code to allow the 7,500-square-foot grading area <br />prescribed by the zoning regulations to be exceeded for the lot located at 24 Grey Eagle <br />Ct. Zoning for the property is PUD-LDR (Planned Unit Development - Low Density <br />Residential) District. <br /> <br />Commissioner Roberts advised that she has consulted with the City's legal counsel and she <br />does not have a conflict of interest with this matter. <br /> <br />Heidi Jo Kline presented the staff report, providing an overview of the appeal and application, <br />the history of the development of a plan for this lot, and the design of the house that is currently <br />being proposed by Mr. Roberts. Ms. Kline reported that staff believes that the proposal as <br />submitted by Mr. Roberts fully complies with all the PUD development plan requirements and <br />the direction of the Planning Commission, and provides a balanced, equitable solution that <br />addresses the concerns of the neighbors on both sides of the lot. She noted that a number of <br />new exhibits have been distributed to the Planning Commission in the last several days, <br />including a tree report on some off-site redwood trees, a photo montage viewed from the <br />Bentley residence, and a copy of the CC&R's for the development. <br /> <br />r- <br /> <br />Commissioner Arkin questioned the square footage of the other homes in the development. <br />Ms. Kline advised that there was a minimum requirement in the CC&R's of 2,000 square feet, <br />but she understands that the homes range from the mid-3,000 to 5,000 square feet. <br /> <br />THE PUBLIC HEARING WAS OPENED <br /> <br />COMMENTS FROM THE APPELLANT <br /> <br />,-- <br /> <br />Robert Grove, 28 Grey Eagle Court, provided background on the development ofMr. Robert's <br />proposal, the discussion that took place at the September 2000 Planning Commission meeting, <br />and the direction of the Planning Commission at that hearing. He referred to a letter from Mr. <br />Jerry Iserson to Mr. Chuck Napier, dated October 17, 1994, noting that in the letter it states that <br />in order to achieve the appropriate balance of the objectives described in the letter the primary <br />ridgeline of the home on this lot should be limited to an elevation of not more that 654.5 feet. <br />Mr. Grove reported that it was the intent of the Planning Commission at its September 2000 <br />meeting to require that a house constructed on lot 12 be located on the northern section of the <br />building envelope. He noted that while Mr. Roberts made several of the requested changes, he <br />did as little as possible to move the house out of the central portion of the building pad. Mr. <br />Grove provided an exhibit depicting the new plan for the house on the site. He noted that the <br />present location places the house 57 feet from the Groves', 105 feet from the Bentley's, and 130 <br />feet from the side of Mr. Schmidt's house.
