Regarding the additional conditions, Mr. Rowe stated that they agreed with those dealing with <br />green building, telecommunications cables, gas fireplaces, and providing first opportunity to <br />Pleasanton workers. However, with respect to the photovoltaic panels, he indicated that this <br />might propose a problem because the project's house plans have been completed and this would <br />require redoing the entire plans. <br /> <br />In response to Commissioner Arkin's inquiry regarding Mardel's sign application for the site, <br />Mr. Rowe stated that the application has been withdrawn. <br /> <br />Commission Roberts asked Mr. Rowe what other Tentative Map requirements are holding the <br />project back. Mr. Rowe replied that they are down to the last few items involving the entry gate, <br />the signing ofthe easements by EBRPD, and the agreement to the Road Maintenance agreement. <br /> <br />Ms. Leslie Johnson, Law Offices of Miller, Starr, Regalia and attorney for Ann Sorensen, stated <br />that they supported the application for extension. She indicated that easements are of primary <br />concern to Ms. Sorensen as she needs them for her property. She advised that they had received <br />some of the easements within the last two weeks and that based on her recent conversation with <br />EBRPD representatives, the draft for the gate easement would be ready in the coming week. <br /> <br />Commissioner Roberts asked Ms. Johnson how the gate to be built by Delco on EBRPD's <br />property is slowing down the process. <br /> <br />r- <br /> <br />Ms. Johnson replied that while Deleo is responsible for building the gate, Delco will be gone <br />once the houses are built and sold. However, Ms. Sorensen will use the road and needs a <br />continuing right to go through that gate. Additionally, there needs to be a mechanism for <br />repairing the gate in the event that it breaks. Because EBRPD owns the property, it is the only <br />party that can give Ms. Sorensen that right. Ms. Johnson added that Ms. Sorensen will give up <br />all her existing easement rights at the time she receives the new easement rights which will be in <br />part on the Final Map, in part referenced on the road easement agreement, and in part in the <br />EBRPD gate easement. <br /> <br />Commissioner Kameny stated that he was comfortable with the project since Ms. Sorensen's <br />lawyer supports it and staff will ensure that all documents are in place prior to Final Map <br />approval. <br /> <br />Mr. Doyle Heaton, Deleo Builders, stated that this process has taken several months because five <br />parties are involved, including the City, and they want to make sure the easements are correct. <br /> <br />THE PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Sullivan stated that he had two major points: (1) He has not supported the project <br />from the beginning because he thinks too many houses are being cramped into this location and <br />that it is out of place for the west side of Foothill Road. He pointed out that there is practically <br />no development from Tehan Canyon Road to Bernal Avenue.
