Any such Improvements shall be shown on as -built drawings that shall be delivered to <br /> the Director within thirty (30) days of completion of the work. <br /> 3.06 Parking Lot Joint Use. LIFETIME TENNIS acknowledges that the parking lot at the <br /> Park is a joint use facility used both by patrons of the Facilities and by persons accessing the <br /> Park. LIFETIME TENNIS shall reasonably observe the parking lot and promptly report to <br /> CITY any improper or illegal conduct. <br /> 3.07 Annual Plan. <br /> 3.07.1 Preparation of the Annual Plan. LIFETIME TENNIS shall submit to Director <br /> the Annual Plan for TENNIS for the next Operating Year ( "Annual Plan ") by February 1 prior <br /> to the start of that Operating Year. <br /> 3.07.2 Contents of the Annual Plan. The Annual Plan shall include: <br /> a) Operating budget showing Tennis Expenses for previous year and estimates <br /> of all Tennis Expenses for the next Operating Year and for CITY's two -year budget, <br /> including expenditures for: (i) property operation and maintenance, (ii) repairs, <br /> replacements, and alterations which do not constitute Capital Expenditures, (iii) <br /> Furnishings and Equipment and Cost of Goods Sold, and (iv) advertising, sales, and <br /> business promotion; <br /> b) Actual numbers for previous years and estimates for the following Operating <br /> Year for the following items: (i) Gross Revenues separated into court fees, lesson fees, <br /> camp fees, merchandise revenue, food and beverage revenue, and tournament revenue, <br /> (ii) number of employees, (iii) court usage categorized by weekday /weekend/holiday, <br /> time of day, rate and residents /nonresidents; <br /> c) Capital Expenditures in previous years and budget for proposed Capital <br /> Expenditures ( "Capital Budget "); <br /> d) Maintenance Plan including a report of maintenance activities undertaken <br /> during the current year as well as projections for the next Operating Year; <br /> e) Marketing and Promotion Plan for TENNIS including a report of activities <br /> undertaken during the current year as well as projections for the next Operating Year; <br /> and <br /> f) Results of the Service Audit Program conducted in previous years and plans <br /> for the next Operating Year. <br /> 3.07.3 Approval of the Annual Plan. The Director shall review the Annual Plan and <br /> make a recommendation to the Parks & Recreation Commission, which will act on any <br /> requested change to the fees. The City Council shall act on approval of the Annual Plan, with <br /> the City -wide budget process. <br /> 5 <br />
