John Pedicini, 2170 Otoole Avenue, San Jose, advised that he is the property owner of Lock It
- Up Self Storage. He noted that he shares some of the concerns expressed by the previous
speakers. He advised that he has a number of other self-storage facilities in partnerships with
others and they have other communication facilities like this one. He noted that in comparison to
the others this one is over-designed in terms of being stealth. He further noted that they spend a
lot more money pro rata on this facility for landscaping and maintaining the general appearance
ofthe facility because of its location. He advised that as part ofthe lease there are requirements
that the tree pole be maintained in an appearance that this consistent with the rest of the facility.
He commented that storage facilities are generally a good location for these types of towers
because they have very few people in the area for any length oftime. He stated that this location
on the property is as far as it can get from residential neighborhoods. He encouraged the
Planning Commission to place this item on its next agenda.

Chairperson Sullivan closed the public comment.

Mr. Pavan advised that providing the exhibits can be prepared in time, this application could
potentially be scheduled as the first item on the September 12 agenda.

In response to an inquiry from Commissioner Kameny, Ms. Eisenwinter clarified that a condition
of approval requires that three trees be installed. Ms. Eisenwinter pointed out the proposed trees
in the photo simulations. Discussion ensued regarding the reasons for selecting eucalyptus trees
as the replacement trees. Commissioners Kameny and Roberts stated that they are comfortable
with staff's recommendations.

-

Chairperson Sullivan stated that he understands and sympathizes with the neighbors' concerns
and he feels that the Planning Commission has tried very hard to get this facility as far away
from the residential neighborhood as possible, to make the tree pole look like a real tree, and to
protect the neighbors. He noted that he feels the safe guards are in place from a health and
monitoring standpoint.

Chairperson Sullivan confirmed that if the Planning Commission approves this application, it
would go to the City Council only ifthe decision is appealed. Ms. Eisenwinter noted that the
appeal would be on the design, not the location.

Chairperson Sullivan stated that the Commission concurs with staff's recommendations. He
advised that he would like to see a condition of approval requiring that the color, texture, and
leaves be maintained through the life of the tree.

The Planning Commission recessed for a break at 9:00 p.m.

Chairperson Sullivan reconvened the meeting at 9:10 p.m.

Commissioner Harvey returned to the dais.

.-

PLANNING COMMISSION MINUTES

August 22,2001

Page 9
