THE PUBLIC HEARING WAS OPENED

,/"

COMMENTS FROM THE APPLICANT

Patrick Pickerell, 5090 Independence Drive, President of Peri dot, stated that he understands how,
to some degree, the initial color scheme presented caused people not to look closely at the design
of the building. He noted that their primary goal was to try to submit noticeably tone-downed
color schemes. He further noted that the applicants and the project architect had an opportunity
to meet with Commissioner Maas, and they have tried to incorporate many of the items related to
the architecture of the building that were discussed at that meeting, which are reflected in the
rendering presented this evening. He noted that the original staff recommendation was that the
design of the building was appropriate, noting that they recognized that negotiations on the color
scheme are part of the process. He commented that they want to be bold and distinctive in the
design and want to make a statement. He advised that the design is in keeping with their
corporate image that they have conveyed to their customers. Mr. Pickerell noted that the time
factor is somewhat critical to them, in that the construction documents on this project are 75-80%
completed based on the initial staff approval. He further noted that if they are required to go
back and significantly alter the design, they would expect an at least two- to three- month delay.
He commented that eight business owners in the Stanley Business Park fully support the design
and alternative color schemes, including the four adjacent property owners.

,.,.--

In response to a question from Commissioner Arkin as to whether the applicant believes that
certain building architecture is appropriate in some areas and not in others, Mr. Pickerell asked
the Commission to look at the rendering which depicts the street view with the proposed building
and the two immediate adjacent buildings. Commissioner Arkin advised that he is trying to see
how a Spanish-style McDonald's restaurant is going to fit with this building. Mr. Pickerell noted
that the specific wording of the original staff report recommended that the design should be
approved, and that staffs objection was to the color. Mr. Pickerell further noted that Mr.
Cannon stated that the applicant should be commended for the bold approach they were taking.

Chairperson Sullivan commented that at the last Planning Commission meeting the applicant
became aware that the design was an issue. Mr. Pickerell stated that they are at the 75-80%
design of the project, based on initial favorable reports, and they would not have gone this far if
they had encountered resistance at earlier phases. Commissioner Maas noted that some
architectural changes have been made.

In response to an inquiry from Chairperson Sullivan, Mr. Pickerell stated that they would like to
have a vote of the Commission to approve the project as submitted, with a condition that the
issue of the colors be resolved.

In response to an inquiry from Commissioner Maas, Mr. Pickerell advised that he does not have
a strong preference for any of the three alternative color schemes, noting that Mrs. Pickerell does
have a strong preference. He further advised that while they would like to see one of the color
schemes presented this evening accepted, they will continue to work on the colors if the
Commission deems it appropriate.

."--

PLANNING COMMISSION MINUTES

May 23, 2001

Page 8
