<br />r- <br /> <br />Ms. Seto responded to an inquiry from Chairperson Sullivan, advising that both parties have the <br />right to share the well water and to the extent that one party wants the other party to discontinue <br />that use they would have to come to an agreement to either buy-out that right or find another <br />means to extinguish the other person's legal right. Ms. Seto confirmed that if the Planning <br />Commission took no action regarding this issue, the Chrismans would still be required to <br />relinquish the use of the well water for their house. <br /> <br />Commissioner Arkin stated that he is convinced that if this number of houses is to be built on <br />this site, this is the appropriate location, but he noted that he does not want this many houses. He <br />suggested that consideration be given to giving a mixed recommendation to the City Council that <br />communicates that the Planning Commission feels this is too many houses for the property, but if <br />the Council supports the number of houses this is the best project that can be put together. He <br />noted that he would like to see all of the open issues finalized. Commissioner Arkin stated that <br />he would like to have the other Commissioners have an opportunity to visit the site to determine <br />if there are any other possibilities or options available. He stated that he would like to go <br />through the issues to make sure this is the best possible project they can recommend to the City <br />Council. <br /> <br />Commissioner Maas stated she would like the Planning Commission to take action this evening <br />and asked that consideration be given to applying conditions that would address the issues of <br />concerns and provide Council with the areas that should be resolved. <br /> <br />Chairperson Sullivan advised that he agrees that there are too many houses for this project, and <br />he feels that it does not meet the intent of the General Plan or the Specific Plan with regard to <br />r- grading, visibility of houses, and a development that fits into the vineyard area. He noted that <br />while he appreciates all of the efforts of the staff and developer, he feels that too many units are <br />being placed into too small of a site. <br /> <br />Discussion ensued regarding the potential Planning Commission action and moving the proposal <br />forward to the City Council. <br /> <br />Chairperson Sullivan advised that he has previously requested, and he is asking, again, for an <br />economic, visual, and grading analysis of a project with a smaller number of units on larger lots <br />to determine if it will accomplish the same needed funding, but have less of an impact. <br /> <br />Discussion ensued regarding the School District's proposed timeframe for the construction of the <br />new elementary school. <br /> <br />Commissioner Maas stated that she is not in support of seeing this project again, and that she <br />would like the Planning Commission to act on this item this evening. <br /> <br />Commissioner Arkin advised that he feels this is a very sensitive project and he doesn't feel <br />comfortable sending it to the City Council with areas of concern that need to be resolved.
