RESOLUTION NO. 10-410 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING WAIVER OF PROPERTY TAX REVENUE FOR LONESTAR'S <br /> PARCEL (APN 946- 4598 - 019 -00) <br /> WHEREAS, Section 99 of the Revenue and Taxation Code (AB 8) provides, <br /> among other things, that no local agency jurisdictional change can be completed without <br /> the agencies affected by such change first agreeing upon an exchange of property tax <br /> revenue between and among the affected agencies; and <br /> WHEREAS, The City of Pleasanton adopted Resolution 05 -082 and the Board of <br /> Supervisors adopted Resolution R- 2008 -20 approving the agreement between the City <br /> and the County regarding transfer of property tax revenue for Annexation /Detachment <br /> No. 148, Vineyard Avenue Realignment; and <br /> WHEREAS, The Annexation /Detachment No. 148, Vineyard Avenue <br /> Realignment became effective October 13, 2008. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of <br /> Pleasanton does resolve, declare, determine, and order the following: <br /> Section 1. City of Pleasanton hereby waives any right, interest, or claim to <br /> property tax revenue on the subject parcel (APN 946- 4598 - 019 -00) following the <br /> detachment. The detachment of the Lonestar parcel (APN 946- 4598 - 019 -00) from the <br /> City of Pleasanton will be effective as to each property annexed /detached within the <br /> annexation /detachment area for the fiscal year following the filing with the State Board <br /> of Equalization of the Certificate of Completion for such property, provided the filing <br /> occurs prior to December 31 of the preceding year; and <br /> Section 2. A certified copy of this resolution shall be transmitted to the Alameda <br /> County Local Agency Formation Commission and to the County of Alameda; and <br /> Section 3. This resolution shall become effective immediately upon its passage <br /> and adoption. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of <br /> Pleasanton at a regular meeting held on November 16, 2010. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the <br /> foregoing resolution was adopted by the City Council at a regular meeting held on the <br /> 16 day of November 2010 by the following vote: <br /> Ayes: Councilmembers Cook- Kallio, McGovern, Sullivan, Vice Mayor Thorne <br /> Noes: None <br /> Absent: Mayor Hosternan <br /> Abstain: None <br /> ' 1 <br />
