RESOLUTION NO. 10-412 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AUTHORIZING THE CITY OF PLEASANTON TO PARTICIPATE IN THE BAY AREA <br /> RECYCLED WATER COALITION (BARWC) FEDERAL LEGISLATIVE EFFORTS <br /> WHEREAS, Title XVI of the Reclamation Wastewater and Groundwater Study and <br /> Facilities Act of 1992 (Title XVI) authorized a feasibility study of the potential for development of <br /> facilities to reclaim water in the San Francisco Bay Area; and <br /> WHEREAS, Title XVI provides a program for Federal participation through cost sharing <br /> for authorized recycled water projects; and <br /> WHEREAS, to promote and obtain legislation to authorize federal funding for Bay Area <br /> recycled water projects through Title XVI, the Bay Area Recycled Water Coalition (BARWC) was <br /> formed between the City of Mountain View, a Charter City and Municipal Corporation; City of <br /> Palo Alto, a Charter City; City of Redwood City, a Charter City; and the City of San Jose, a <br /> Municipal Corporation, an administering agency for the San Jose /Santa Clara Water Pollution <br /> Control Plant, a joint powers agency formed pursuant to California Government Code section <br /> 6500, et seq.; the Delta Diablo Sanitation District, a County Sanitation District formed pursuant <br /> to California Health and Safety Code Section 4700 et seq.; North Coast County Water District, <br /> formed under the County Water District Act, California Water Code Section 30000, et. seq.; <br /> Santa Clara Valley Water District, a Special District created by an act of the California <br /> Legislature ( "Participating Agencies ") and the Bay Area Clean Water Agencies, a joint powers <br /> agency formed pursuant to California Government Code section 6500 et seq.; and <br /> WHEREAS, the Tri- Valley area has current and future recycled water projects that <br /> qualify for Title XVI authorizing and cost sharing; and <br /> WHEREAS, the City of Pleasanton wishes to obtain funding for current and future <br /> recycled water projects in the Tri - Valley, and the City has determined that joining BARWC <br /> provides a means to obtain legislative funding for those projects; and <br /> WHEREAS, to join BARWC, the City must enter into that certain agreement with <br /> Participating Agencies entitled, "Memorandum of Agreement Bay Area Recycled Water <br /> Coalition (BARWC) Federal Legislative Efforts', and execute a "Membership Addendum." <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pleasanton as <br /> follows: <br /> Section 1. That certain agreement entitled "Memorandum of Agreement Bay Area <br /> Recycled Water Coalition (BARWC) Federal Legislative Efforts" (Exhibit A), by and between <br /> Participating Agencies, to which copy reference is hereby made for the full particulars thereof, is <br /> hereby approved to form, and the City Manager and City Council are hereby authorized and <br /> directed to execute, the Membership Addendum (Exhibit B) on behalf of the City of Pleasanton. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on November 16, 2010. <br /> 1 <br />
