RESOLUTION NO. 10407 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> APPROVING A MITIGATED NEGATIVE DECLARATION FOR THE APPLICATION OF <br /> PLEASANTON GATEWAY, L.L.C., AS FILED UNDER CASE PUD- 02 -07M AND CASE <br /> PCUP -210. <br /> WHEREAS, at its meeting of October 19, 2010, the City Council received a proposed <br /> Mitigated Negative Declaration for the application of Pleasanton Gateway, L.L.C., for a Planned <br /> Unit Development major modification to modify the approved development plan for its property on <br /> the south side of Bernal Avenue, between the northbound I- 680 /Bernal Avenue exit ramp and <br /> Valley Avenue, to allow approximately 129,370 square feet of commercial /retail floor area and <br /> approximately 588,781 square feet of office floor area on an approximately 39.22 -acre site, revised <br /> uses, and off -site construction at the Bernal Avenue /Koll Center Drive intersection and the Bernal <br /> AvenueNalley Avenue intersection (PUD- 02 -07M); and the application for a Conditional Use <br /> Permit for the operation of a grocery store and drive - through uses (PCUP -210); and <br /> WHEREAS, the City Council received and reviewed the Initial Study, dated August 2, <br /> 2010, and received the recommendations of the staff, the Planning Commission; and <br /> WHEREAS, a duly noticed public hearing was held on October 19, 2010, at which time <br /> the public was given the opportunity to comment on the environmental impacts of the proposed <br /> project, and where the City Council received written comments from other organizations and <br /> interested persons; and <br /> WHEREAS, the City Council has reviewed the potential impacts of the proposed project <br /> in accordance with the applicable state and local laws and guidelines governing the preparation <br /> of Mitigated Negative Declarations; and <br /> WHEREAS, the City Council finds that there is no substantial evidence, in light of the <br /> whole record, that the proposed project, as mitigated, may have a significant effect on the <br /> environment. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br /> SECTION 1. Approves the Mitigated Negative Declaration for the application of Pleasanton <br /> Gateway, L.L.C., for a Planned Unit Development major modification to modify the approved <br /> development plan for its property on the south side of Bernal Avenue between the northbound 1- <br /> 680 /Bernal Avenue exit ramp and Valley Avenue to allow approximately 129,370 square feet of <br /> commercial /retail floor area and approximately 588,781 square feet of office floor area on an <br /> approximately 39.22 -acre site, revised uses, and off -site construction at the Bernal Avenue /Koll <br /> Center Drive intersection and the Bernal AvenueNalley Avenue intersection (PUD- 02 -07M); and <br /> the application for a Conditional Use Permit for the operation of a grocery store and drive - through <br /> uses (PCUP -210); <br /> SECTION 2.
