e) Outdoor Dining: <br /> Outdoor dining, including the sale of alcoholic beverages with food, may take place <br /> for the Phase I Major Tenant #1 and for a Phase I restaurant, cafe, bakery, and ice <br /> cream and yogurt establishment located in any Phase I building. All outdoor dining <br /> shall conform to the approved site plan locations. At no time shall the sidewalks be <br /> obstructed for pedestrians, and a minimum clearance of four -feet shall be <br /> maintained at all times between the sidewalk and the driveways. Outdoor dining <br /> shall be reviewed by the Planning Division for conformance with the standards set <br /> forth under PUD- 02 -07M. No outdoor dining is permitted in the parking areas or <br /> the building setback areas facing Bernal Avenue and Valley Avenue. <br /> f) Truck Deliveries: <br /> Truck deliveries including loading /off - loading activities shall be as follows: <br /> • Phase I Major Tenant #1 (Safeway): No limitation on delivery /loading/ <br /> unloading hours unless a residential use is approved on the Phase II portion of <br /> the site when the hours shall be from 6:00 a.m. to 12:00 p.m. <br /> • Phase I Major Tenant #2 (Drive - Through Pharmacy): From 6:00 a.m. to 10:00 <br /> p. m. <br /> • Phase 1 Pad and Retail Buildings: From 6:00 a.m. to 10:00 p.m. <br /> • Parking lot sweeping and garbage pick -up: From the hours of 6:00 a.m. to <br /> 10:00 p.m. <br /> All delivery trucks and vendors shall use the Bernal Avenue driveway to enter /exit <br /> the development. All tenants shall notify their vendors and delivery personnel of <br /> the approved delivery route and times. <br /> g) Pallets and Cardboard: <br /> Pallets shall be collected and stored in an enclosure designated for the temporary <br /> storage of empty pallets located in the service area. Cardboard boxes shall be <br /> baled and hauled offsite to a recycling facility. <br /> 4. If the operation of these uses and drive - through lanes result in conflicts pertaining to <br /> parking, noise, traffic, property maintenance including litter, or other impacts, at the <br /> discretion of the Community Development Director, this conditional use permit or any <br /> portion of the conditional use permit may be referred to the Planning Commission for <br /> subsequent review at a public hearing. If necessary, the Planning Commission may <br /> modify or add conditions of approval to mitigate such impacts. <br /> 5. All businesses shall maintain the area surrounding their tenant space in a clean and <br /> orderly manner at all times. <br /> < End > <br /> 2 <br />
