RESOLUTION NO. 10-406 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF PLEASANTON GATEWAY, L.L.C., FOR A <br /> CONDITIONAL USE PERMIT AS FILED UNDER PCUP -210 FOR THE OPERATION OF <br /> A GROCERY STORE AND DRIVE - THOUGH USES ON THE APPROXIMATELY 12.5 - <br /> ACRE COMMERCIAL /RETAIL PORTION OF A 39.22 -ACRE SITE ON THE SOUTH <br /> SIDE OF BERNAL AVENUE BETWEEN THE NORTHBOUND I- 680 /BERNAL AVENUE <br /> EXIT RAMP AND VALLEY AVENUE (6750 BERNAL AVENUE) <br /> WHEREAS; Pleasanton Gateway, L.L.C., has applied for a conditional use permit <br /> (PCUP -210) for the 12.50 -acre portion of its 39.22 -acre property located on the south side of <br /> Bernal Avenue between the northbound I- 680 /Bernal Avenue exit ramp and Valley Avenue (6750 <br /> Bernal Avenue) to allow the operation of a grocery store and drive - through uses in conjunction <br /> with its PUD development plan PUD- 02 -07M; and <br /> WHEREAS, zoning for the property is PUD — C (Planned Unit Development — <br /> Commercial) District; and <br /> WHEREAS, at its meeting of October 19, 2010, the City Council received information <br /> in the staff report, testimony from members of the public, and the Planning Commission's <br /> August 25, 2010 recommendation for approval of the Mitigated Negative Declaration, PUD <br /> Major Modification (PUD- 02 -07M), and the Conditional Use Permit (PCUP -210); and <br /> WHEREAS, based on the Initial Environmental Study and pursuant to Resolution No. <br /> 10 -407, the City Council adopted the Mitigated Negative Declaration for the proposed project <br /> pursuant to the requirements of the California Environmental Quality Act (CEQA); and <br /> WHEREAS, after a review of the materials and consideration of the testimony <br /> presented, the City Council introduced Ordinance No. 2014 for PUD- 02 -07M approving the PUD <br /> major modification for the development plan showing the grocery store and drive - through uses <br /> covered by this conditional use permit; and <br /> WHEREAS, after receiving public testimony and review of the materials presented, the <br /> City Council on October 19, 2010, determined that the proposed conditional use permit for the <br /> operation of a grocery store and drive - through uses, as conditioned, are appropriate for the site <br /> and consistent with the PUD development plan approval under PUD- 02 -07M. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br /> SECTION 1. Approves Case PCUP -210, the application by Pleasanton Gateway, <br /> L.L.C., for a conditional use permit on a 12.50 -acre portion of its 39.22 -acre property located on <br /> the south side of Bernal Avenue between the northbound 1 -680/ Bernal Avenue exit ramp and <br /> Valley Avenue (6750 Bernal Avenue) to allow the operation of a grocery store and drive - through <br /> uses in conjunction with PUD- 02 -07M subject to the conditions shown on Exhibit B, attached <br /> here and incorporated herein by reference. <br />
