RESOLUTION NO. <br /> RESOLUTION OF THE BOARD OF DIRECTORS OF DUBLIN SAN RAMON SERVICES <br /> DISTRICT APPROVING REFUNDING UNUSED SEWER CAPACITY TO CITY OF <br /> PLEASANTON IN ACCORDANCE WITH DISTRICT CODE SECTION 7.2.12.B <br /> WHEREAS, Section 7.2.18 of the District Code authorizes Dublin San Ramon Services <br /> District ( "District "), in accordance with the public health, wdre, safety, necessity and <br /> convenience, to issue permits for future connections to the Distiict s Wastewater system; and <br /> WHEREAS, Section 7.5.13 of the District Code,..authorizes the District to enter into an <br /> agreement with a govemmental agency to provide'wa5tewater collection and /or treatlrtent services in <br /> iw <br /> exchange for special rates and charges representing an`e „uitabjk share of the costs thereof; and <br /> y #y .. <br /> WHEREAS, Section 7.2.17 ofthobis rictCode authOriKes the District, in accordance with <br /> the public health, welfare, safety, necessityAnd cOrMationce, to Otter into an agreement with a <br /> t R <br /> govemmental agency for, ftbrity 'g¢uernmentatctsn4tectIons to the District's wastewater system to <br /> 1".? <br /> F <br /> facilitate the governtfa ttal agency'Sperformanc 9t necessary governmental functions or services <br /> x'wuq s s 6 :4 'h '} <br /> under its jurisdiction; ante 4, <br /> :31 <br /> fi 2EAS, aeetion 7.2. of the District Code provides for the acquisition by governmental <br /> agenciesof capacity rights- iil&the Distr it's wastewater system; and <br /> WHEREAS, Section 7.2.12.8 of the District Code authorizes the District to refund, to <br /> governmental agencies, fees-paid for the acquisition of capacity rights in excess of the agencies' <br /> requirements, as determined and /or verified by the District ( "excess fees "); and <br /> WHEREAS, Section 1(k) of the Agreement for Wastewater Disposal Services by and <br /> between the District and City of Pleasanton ( "City") dated November 3, 1992 provides that dwel ling <br /> unit equivalents ( "DUEs ") shall be administered pursuant to District Code; and <br /> WHEREAS, City has purchased forty seven and eight tenths (47.8) DUEs excess sewer <br />
