18 <br /> THE CITY OF <br /> - -� W� "" CITY COUNCIL AGENDA REPORT <br /> pLE ASANTON, <br /> November 16, 2010 <br /> City Manager <br /> TITLE: APPROVAL OF SECOND AMENDMENT TO FINANCING <br /> ADMINISTRATION AGREEMENT (FAA) WITH DUBLIN SAN RAMON <br /> SERVICES DISTRICT (DSRSD) <br /> SUMMARY <br /> At the November 8, 2010 DSRSD /Pleasanton Liaison Committee (Committee) meeting, <br /> the Committee approved the Second Amendment to the Financing Administration <br /> Agreement (Amendment). The Amendment includes the following changes to the FAA: <br /> • Modification to Paragraph 6 to provide specific and reasonable criteria for joint <br /> agency review of capital projects <br /> • Modification to Paragraph 7(e) to remove the provision for formula driven <br /> automatic increases to connection fees (that is not in compliance with AB1600) <br /> and replaces it with the AB1600 compliant nexus study to determine increases to <br /> regional connection fees <br /> • Modification to Paragraph 7(f) requiring joint agency approval regarding the <br /> disposition of any excess funds over and above the Administrative Target Level <br /> of 5 times maximum annual debt service (5X). <br /> RECOMMENDATION <br /> Staff recommends Council authorize the City Manager to sign the Second Amendment <br /> to the FAA. <br /> FINANCIAL STATEMENT <br /> There are no financial impacts to the City as a result of the Amendment to the FAA. <br />
