Ordinance 1878 <br />Page 5 <br /> <br />the issue. Upon conclusion of the hearing, the City Manager shall render a decision and <br />order which shall be final. <br />G. If an appeal is filed, payment of the bill shall be suspended until the City Manager <br />has rendered a decision. <br />H. This Section shall not apply when the detained minor is booked into Juvenile Hall <br />rather than released to a parent or guardian. <br /> <br />10.08.070 Separate Violation: <br />Any person who violates a provision of this Chapter is guilty of a separate offense for <br />each day or part ora day during which a violation is committed or continued. <br /> <br />10.08.080 Remedies Cumulative; Juvenile Diversion Program; Relationship to <br />Other Laws. The remedies under this chapter are cumulative, and shall not restrict the <br />City to any other remedy to which it is entitled under law or equity, including an <br />administrative fine under Chapter 1.24. The first time an individual under eighteen (18) <br />years of age violates section 10.08.050, unless extraordinary circumstances exist, the <br />Police Department shall issue a courtesy citation to the individual and contact the <br />individual's parent or guardian, in lieu of imposing an administrative fine under Chapter <br />1.24. The second time an individual under eighteen (18) years of age violates section <br />10.08.050, the Police Chief may require the violator to participate in the Pleasanton <br />Juvenile Diversion Program, in lieu of imposing an administrative fine under Chapter <br />1.24. If the minor completes the Pleasanton Juvenile Diversion Program, the citation <br />shall be voided. Nothing in this Chapter shall be deemed to preclude the imposition of <br />any criminal penalty under state law, or prohibit any conduct authorized by the state or <br />federal constitution. <br /> <br />Section2: <br /> <br />A summary of this ordinance shall be published once within fifteen (15) <br />days after its adoption in "The Valley Times", a newspaper of general <br />circulation published in the City of Pleasanton, and the complete <br />ordinance shall be posted for fifteen (15) days in the City Clerk's office <br />within fifteen (15) days after its adoption. <br /> <br />Section 3: <br /> <br />This ordinance shall be an urgency measure to take effect immediately <br />upon its adoption for the following reasons: spring break is fast <br />approaching (April 18 - 25, 2003 for the Pleasanton Unified School <br />District) and during this time, the Police Department traditionally has an <br />increase in calls to teen parties (both at private residences and hotels) and <br />some of these parties involve alcohol; and having this ordinance in place <br />during spring break will permit the Police Department to curb underage <br />drinking at parties, and improve public safety by reducing the <br />likelihood of serious and/or fatal injuries (including automobile <br />accidents), crimes, altercations, neighborhood vandalism and <br />excessive noise, all which can be associated with the consumption of <br />alcohol at teen parties. <br /> <br />5 <br /> <br /> <br />
