Ordinance 1878 <br />Page 2 <br /> <br />K. "Emergency" means unforeseen circumstances or a situation that calls for <br />immediate action. The term includes, but is not limited to, an automobile collision, fire, <br />explosion, natural disaster or any situation requiring immediate action to prevent serious <br />bodily injury or death. <br /> <br />10.08.020 Curfew: <br />A. It is unlawful for any minor to remain in any public place or on the premises of <br />any establishment within the City during curfew hours. <br />B. It is unlawful for any parent, guardian or responsible adult to knowingly permit a <br />minor, or by insufficient control, allow the minor to remain in any public place or on the <br />premises of any establishment within the City during curfew hours. <br />C. It is unlawful for any owner, operator or employee of an establishment to <br />knowingly permit a minor to remain in or upon the premises of an establishment within <br />the City during curfew hours. <br /> <br /> 10.08.030 Exceptions: <br />A. Minors are exempt from this Chapter when: <br /> 1. The minor is accompanied by the minor's parent, guardian or responsible <br /> adult. <br /> 2. The minor is on an errand at the direction of the minor's parent, guardian <br /> or responsible adult, without delay or detour. <br /> 3. The minor is in a vehicle involved in interstate or intrastate travel. <br /> 4. The minor is engaged in employment, or going to or returning home from <br /> employment, without detour or delay. <br /> 5. The minor is involved in an emergency. <br /> 6. The minor is on the sidewalk abutting the minor's residence or abutting the <br /> residence of a next door neighbor, and the neighbor has not complained to <br /> the police about the minor's presence, providing the minor is not otherwise <br /> violating the law. <br /> 7. The minor is attending an official school, religious or other adult- <br /> supervised recreational activity sponsored by the City, a civic organization <br /> or other such entity that takes responsibility for the safety of the minor, or <br /> when the minor is going to or returning home from such activity, without <br /> detour or delay. <br /> 8. The minor is exercising First Amendment rights protected by the United <br /> States Constitution such as the flee exercise of religion, freedom of speech <br /> or the right of lawful assembly. <br /> 9. The minor is married or emancipated pursuant to law. <br />B. The owner, operator or an employee of an establishment is exempt from <br />prosecution under subsection 10.08.020C of this Chapter if he or she notified the police <br />that a minor was present in violation of this Chapter and such minor refused to leave. <br /> <br />2 <br /> <br /> <br />
