ATTACHMENT RESOLUTION NO. 10- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING WAIVER OF PROPERTY TAX REVENUE FOR LONESTAR'S PARCEL (APN 946 -4598- 019 -00) WHEREAS, Section 99 of the Revenue and Taxation Code (AB 8) provides, among other things, that no local agency jurisdictional change can be completed without the agencies affected by such change first agreeing upon an exchange of property tax revenue between and among the affected agencies; and WHEREAS, The City of Pleasanton adopted Resolution 05 -082 and the Board of Supervisors of Alameda County adopted Resolution R- 2008 -20 approving the agreement between the City and the County regarding transfer of property tax revenue for Annexation /Detachment No. 148, Vineyard Avenue Realignment; and WHEREAS, the Annexation /Detachment No. 148, Vineyard Avenue Realignment became effective October 13, 2008; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pleasanton does resolve, declare, determine, and order the following: Section 1. City of Pleasanton hereby waives any right, interest, or claim to property tax revenue on the subject parcel (APN 946- 4598 - 019 -00) following the detachment. The detachment of the Lonestar parcel (APN 946- 4598 - 019 -00) from the City of Pleasanton will be effective as to each property annexed /detached within the annexation /detachment area for the fiscal year following the filing with the State Board of Equalization of the Certificate of Completion for such property, provided the filing occurs prior to December 31 of the preceding year. Section 2. A certified copy of this resolution shall be transmitted to the Alameda County Local Agency Formation Commission and to the County of Alameda. Section 3. This resolution shall become effective immediately upon its passage and adoption. PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on November 16, 2010.
