CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 03-015 <br /> <br />RESOLUTION DENYING THE APPEAL (PAP-46) OF THE <br />DECISION OF THE PLANNING COMMISSION AND <br />THEREBY DENYING THE APPLICATION OF JOHN <br />DUGGAN FOR DESIGN REVIEW APPROVAL TO <br />CONSTRUCT ADDITIONS TO THE DWELLING AT 3573 <br />KINGS CANYON COURT <br /> <br />WHEREAS, <br /> <br />on December 16, 2002, the Zoning Administrator approved the application of John <br />Duggan for administrative design review to construct additions to the existing <br />dwelling at 3573 Kings Canyon Court; and <br /> <br />WHEREAS, zoning for the property is R-1-6,500 (Single-Family Residential) District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, a neighbor submitted <br /> an appeal to the City of Pleasanton; and <br /> <br />WHEREAS, at its meeting of January 22, 2003, the Planning Commission upheld the appeal, <br /> thereby denying Case PADR-669; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, John Duggan <br /> submitted an appeal of the Planning Commission's decision; and <br /> <br />WHEREAS, a duly noticed public hearing was held before the City Council on March 18, 2003, <br /> at which time all pertinent testimony and documents were reviewed; and <br /> <br />WHEREAS, the Council determines that the proposed design is not compatible with the existing <br /> homes and the neighborhood character. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Denies, without prejudice assuming the timely completion of the matters set forth <br />in Section 2 of this resolution, the application of John Duggan (Case PADR-669) <br />for administrative design review approval to construct additions to the existing <br />dwelling at 3573 Kings Canyon Court; assuming such timely completion, the <br />application may be processed further through design review. <br /> <br /> <br />
