CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 03-015 RESOLUTION DENYING THE APPEAL (PAP-46) OF THE DECISION OF THE PLANNING COMMISSION AND THEREBY DENYING THE APPLICATION OF JOHN DUGGAN FOR DESIGN REVIEW APPROVAL TO CONSTRUCT ADDITIONS TO THE DWELLING AT 3573 KINGS CANYON COURT WHEREAS, on December 16, 2002, the Zoning Administrator approved the application of John Duggan for administrative design review to construct additions to the existing dwelling at 3573 Kings Canyon Court; and WHEREAS, zoning for the property is R-1-6,500 (Single-Family Residential) District; and WHEREAS, within the time specified by the Pleasanton Municipal Code, a neighbor submitted an appeal to the City of Pleasanton; and WHEREAS, at its meeting of January 22, 2003, the Planning Commission upheld the appeal, thereby denying Case PADR-669; and WHEREAS, within the time specified by the Pleasanton Municipal Code, John Duggan submitted an appeal of the Planning Commission's decision; and WHEREAS, a duly noticed public hearing was held before the City Council on March 18, 2003, at which time all pertinent testimony and documents were reviewed; and WHEREAS, the Council determines that the proposed design is not compatible with the existing homes and the neighborhood character. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Denies, without prejudice assuming the timely completion of the matters set forth in Section 2 of this resolution, the application of John Duggan (Case PADR-669) for administrative design review approval to construct additions to the existing dwelling at 3573 Kings Canyon Court; assuming such timely completion, the application may be processed further through design review.
