CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1179 <br /> <br /> APPROVING THE APPLICATION OF EVH PARTNERSHIP AND THE <br /> ROMAN CATHOLIC BISHOP OF OAKLAND FOR PUD ZONING AND <br /> DEVELOPMENT PLAN APPROVAL OF A 262-UNIT MULTI-FAMILY <br /> RESIDENTIAL DEVELOPMENT AND RELATED FACILITIES ON AN <br /> APPROXIMATELY 13 ACRE SITE LOCATED IMMEDIATELY SOUTHWEST <br /> OF BERNAL AVENUE AND THE SOUTHERN PACIFIC RIGHT-OF-WAY <br /> <br />WHEREAS, EVH Partnership and the Roman Catholic Bishop of Oakland <br /> applied for development plan approval for construction <br /> of a 262-unit multi-family residential development and <br /> related facilities on an approximately 13 acre site <br /> located immediately southwest of Bernal Avenue <br /> (extension) and the Southern Pacific right-of-way; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative <br /> declaration was adopted by Council on January 22, 1985; <br /> and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendation for approval of the development plan and <br /> rezoning; and <br /> <br />WHEREAS, a duly noticed public hearing was held on January 22, <br /> 1985; an <br /> <br />WHEREAS, the City Council finds that this development plan and <br /> rezoning is consistent with the General Plan policies of <br /> the City of Pleasanton; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves the rezoning of an approximately 13 acre <br /> site located immediately southwest of Bernal Avenue <br /> (extension) and the Southern Pacific right-of-way to the <br /> PUD (Planned Unit Development)-High Density Residential <br /> District. The property consists of approximately 8 <br /> acres currently within the City limits and approximately <br /> 5 acres currently outside of the City limits for which <br /> this action shall constitute a prezoning. <br /> <br />Section 2: Approves the development plan for a 262-unit <br /> multi-family residential development and related <br /> facilities on approximately 13 acres located immediately <br /> southwest of Bernal Avenue and the Southern Pacific <br /> Right-of-way, subject to all conditions listed in <br /> Exhibit A for Case PUD-84-21, attached hereto and made <br /> part of this ordinance by reference, <br /> <br /> <br />
