ANALYSIS <br /> City Applications and Approvals <br /> The applicant has submitted the following applications for the proposal: <br /> • PUD- 02 -07M — Modification to the Bernal Property PUD development plan to revise <br /> and update the development plan's entitlements including uses, building and site <br /> design, sign criteria, green building standards, and traffic mitigation; and, <br /> • PCUP -210 — Conditional use permit for the operation of the supermarket and drive - <br /> through uses. <br /> Staff previously stated to the Planning Commission that the Bernal Property Specific Plan <br /> required an amendment to accommodate the revised development plan for the present <br /> proposal — analysis now reveals that an amendment is not necessary. As discussed <br /> further, the Specific Plan permits PUD development plans and development plan <br /> modifications absent a Specific Plan amendment with a finding of consistency with the <br /> Specific Plan, and that the development plan approval may take precedence over the <br /> Specific Plan guidelines.
