ATTACHMENT 3 <br /> RESOLUTION NO. 10-__ <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> APPROVING A MITIGATED NEGATIVE DECLARATION FOR THE <br /> APPLICATION OF PLEASANTON GATEWAY, L.L.C., AS FILED UNDER <br /> CASE PUD- 02 -07M AND CASE PCUP -210. <br /> WHEREAS, at its meeting of October 19, 2010, the City Council received <br /> a proposed Mitigated Negative Declaration for the application of Pleasanton <br /> Gateway, L.L.C., for a Planned Unit Development major modification to modify the <br /> approved development plan for its property on the south side of Bernal Avenue, <br /> between the northbound I- 680 /Bernal Avenue exit rarnp and Valley Avenue, to <br /> allow approximately 129,370 square feet of commercial /retail floor area and <br /> approximately 588,781 square feet of office floor area on an approximately 39.22 - <br /> acre site, revised uses, and off-site construction at the Bernal Avenue /Koll Center <br /> Drive intersection and the Bernal AvenueNalley Avenue intersection (PUD -02- <br /> 07M); and the application for a Conditional Use Permit for the operation of a grocery <br /> store and drive - through uses (PCUP -210); and <br /> WHEREAS, the City Council received and reviewed the Initial Study, <br /> dated August 2, 2010, and received the recommendations of the staff, the <br /> Planning Commission; and <br /> WHEREAS, a duly noticed public hearing was held on October 19, 2010, <br /> at which time the public was given the opportunity to comment on the <br /> environmental impacts of the proposed project, and where the City Council <br /> received written comments from other organizations and interested persons; and <br /> WHEREAS, the City Council has reviewed the potential impacts of the <br /> proposed project in accordance with the applicable state and local laws and <br /> guidelines governing the preparation of Mitigated Negative Declarations; and <br /> WHEREAS, the City Council finds that there is no substantial evidence, in <br /> light of the whole record, that the proposed project, as mitigated, may have a <br /> significant effect on the environment. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF <br /> THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, <br /> AND ORDER THE FOLLOWING: <br /> SECTION 1.
