Exhibit B <br /> PCUP -210 <br /> Draft City Council Conditions of Approval <br /> Pleasanton Gateway Development <br /> 6750 Bernal Avenue <br /> October 19, 2010 <br /> 1. This conditional use permit will lapse within one year from the effective date unless a <br /> building permit is issued and construction has commenced and is diligently pursued <br /> toward completion or the City has approved an extension. <br /> 2. This conditional use permit shall apply to the following; <br /> a) Operation of the Grocery Store tenant for the Major Tenant #1 Building; <br /> b) Operation of the drive - through lane for the Pharmacy tenant for the Major Tenant <br /> #2 Building; <br /> c) Operation of the drive - through lane for Building Pad #1; and, <br /> d) Operation of the drive - through lane for Building Pad #4. <br /> 3. These uses and drive - through lanes shall be subject to the following operating <br /> requirements: <br /> a) Operating Hours: <br /> The Phase I Major Tenant #1 may be open for customers 24 hours per day. The <br /> drive - through lanes for the Phase I Building Pad #1 and Building Pad #4 may <br /> operate 24 hours per day. The drive - through lane for the Phase I Major Tenant #2 <br /> may operate 24 hours per day for a pharmacy for the sale of prescription <br /> pharmaceuticals only. All other transactions for the Major Tenant #2 shall take <br /> place inside the building. <br /> b) Outdoor Storage: <br /> There shall be no outdoor storage except for the loading area behind Major Tenant <br /> #1 and for the trash compactor shown in the service area behind Major Tenant #2. <br /> All storage for the remaining buildings and tenant shall occur entirely within the <br /> building. <br /> c) Shopping Carts: <br /> Major Tenant #1 employees shall continuously monitor the development's parking <br /> areas to ensure that its shopping carts are stored in the enclosures shown on the <br /> plan set. <br /> d) Outdoor Sales and Shopping Center Events: <br /> No more than four shopping center events and an additional four events per tenant <br /> in the locations designated on the master site plan by PUD- 02 -07M for the <br /> sidewalk areas in front of the Phase I buildings and subject to the requirements of <br /> PUD- 02 -07M. All outdoor sales and events shall conform to the approved <br /> locations. Tenants may not transfer events between each other. <br /> 1 <br />
