ATTACHMENT 2 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF PLEASANTON GATEWAY, L.L.C., FOR A <br /> CONDITIONAL USE PERMIT AS FILED UNDER PCUP -210 FOR THE OPERATION OF <br /> A GROCERY STORE AND DRIVE - THOUGH USES ON THE APPROXIMATELY 12.5 - <br /> ACRE COMMERCIAL/RETAIL PORTION OF A 39.22 -ACRE SITE ON THE SOUTH <br /> SIDE OF BERNAL AVENUE BETWEEN THE NORTHBOUND 1- 680 /BERNAL AVENUE <br /> EXIT RAMP AND VALLEY AVENUE (6750 BERNAL AVENUE). <br /> WHEREAS, Pleasanton Gateway, L.L.C., has applied for a conditional use <br /> permit (PCUP -210) for the 12.50 -acre portion of its 39.22 -acre property located on the <br /> south side of Bernal Avenue between the northbound I- 680 /Bernal Avenue exit ramp and <br /> Valley Avenue (6750 Bernal Avenue) to allow the operation of a grocery store and drive - <br /> through uses in conjunction with its PUD development plan PUD- 02 -07M; and <br /> WHEREAS, zoning for the property is PUD — C (Planned Unit Development — <br /> Commercial) District; and <br /> WHEREAS, at its meeting of October 19, 2010, the City Council received <br /> information in the staff report, testimony from members of the public, and the Planning <br /> Commission's August 25, 2010 recommendation for approval of the Mitigated Negative <br /> Declaration, PUD Major Modification (PUD- 02 -07M), and the Conditional Use Permit <br /> (PCUP -210); and <br /> WHEREAS, based on the Initial Environmental Study and pursuant to <br /> Resolution No. 10- , the City Council adopted the Mitigated Negative <br /> Declaration for the proposed project pursuant to the requirements of the California <br /> Environmental Quality Act (CEQA); and <br /> WHEREAS, after a review of the materials and consideration of the testimony <br /> presented, the City Council introduced Ordinance No. — for PUD- 02 -07M <br /> approving the PUD major modification for the development plan showing the grocery <br /> store and drive - through uses covered by this conditional use permit; and <br /> WHEREAS, after receiving public testimony and review of the materials <br /> presented, the City Council on October 19, 2010, determined that the proposed <br /> conditional use permit for the operation of a grocery store and drive - through uses, as <br /> conditioned, are appropriate for the site and consistent with the PUD development plan <br /> approval under PUD- 02 -07M. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. Approves Case PCUP -210, the application by Pleasanton <br /> Gateway, L.L.C., for a conditional use permit on a 12.50 -acre portion of its 39.22 -acre <br /> property located on the south side of Bernal Avenue between the northbound I -680/ <br /> Bernal Avenue exit ramp and Valley Avenue (6750 Bernal Avenue) to allow the <br /> operation of a grocery store and drive - through uses in conjunction with PUD- 02 -07M <br />
