ATTACHMENT 1 <br /> RESOLUTION NO. 10- <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> AMENDING THE PLEASANTON GENERAL PLAN 2005 -2025 TO DELETE <br /> ALL REFERENCES TO THE HOUSING CAP (MEASURE GG, 1996, LIMITING <br /> THE TOTAL NUMBER OF RESIDENTIAL UNITS TO 29,000) <br /> WHEREAS, the City of Pleasanton reached a Settlement Agreement in the matter <br /> of Urban Habitat v. City of Pleasanton; <br /> WHEREAS, the Settlement Agreement stipulates that all references to the housing <br /> cap and related programs and policies throughout the various element of the General Plan <br /> shall be removed by October 19, 2010; <br /> WHEREAS, the City has prepared an amendment to the General Plan (Exhibit A) <br /> which eliminates language related to the 29,000 unit residential cap from the General Plan; <br /> WHEREAS, on July 21, 2009, the City Council reviewed and certified the Final <br /> Environmental Impact Report on the 2005 -2025 General Plan and no further <br /> environmental review is warranted at this time; <br /> WHEREAS, on October 19, 2010, the City Council received the Planning <br /> Commission's positive recommendation for approval of the Project and, on that date, <br /> received reports from the City staff concerning the Project; and <br /> WHEREAS, on October 19, 2010, the City Council conducted a public hearing on <br /> the Project, took testimony from members of the public, and considered the <br /> recommendations of the City staff concerning the Project; and <br /> WHEREAS, the City Council wishes to amend the Pleasanton General Plan <br /> 2005 -2025 as noted in Exhibit A. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. The Pleasanton General Plan 2005 -2025, as adopted in Resolution <br /> 09 -314, is hereby amended as shown in Exhibit A. <br /> SECTION 2. This resolution shall become effective immediately upon its <br /> passage and adoption. <br /> 1 <br />
