ATTACHMENT 1 RESOLUTION NO. 10- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, AMENDING THE PLEASANTON GENERAL PLAN 2005 -2025 TO DELETE ALL REFERENCES TO THE HOUSING CAP (MEASURE GG, 1996, LIMITING THE TOTAL NUMBER OF RESIDENTIAL UNITS TO 29,000) WHEREAS, the City of Pleasanton reached a Settlement Agreement in the matter of Urban Habitat v. City of Pleasanton; WHEREAS, the Settlement Agreement stipulates that all references to the housing cap and related programs and policies throughout the various element of the General Plan shall be removed by October 19, 2010; WHEREAS, the City has prepared an amendment to the General Plan (Exhibit A) which eliminates language related to the 29,000 unit residential cap from the General Plan; WHEREAS, on July 21, 2009, the City Council reviewed and certified the Final Environmental Impact Report on the 2005 -2025 General Plan and no further environmental review is warranted at this time; WHEREAS, on October 19, 2010, the City Council received the Planning Commission's positive recommendation for approval of the Project and, on that date, received reports from the City staff concerning the Project; and WHEREAS, on October 19, 2010, the City Council conducted a public hearing on the Project, took testimony from members of the public, and considered the recommendations of the City staff concerning the Project; and WHEREAS, the City Council wishes to amend the Pleasanton General Plan 2005 -2025 as noted in Exhibit A. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: SECTION 1. The Pleasanton General Plan 2005 -2025, as adopted in Resolution 09 -314, is hereby amended as shown in Exhibit A. SECTION 2. This resolution shall become effective immediately upon its passage and adoption. 1
