01 <br /> MINUTES <br /> CITY OF PLEASANTON <br /> REGULAR CITY COUNCIL MEETING <br /> September 7, 2010 <br /> CALL TO ORDER <br /> Mayor Hosterman called the regular meeting to order at the hour of 7:00 p.m. Councilmember <br /> Cook - Kallio led the Pledge of Allegiance and provided the introductory remarks. <br /> ROLL CALL <br /> Present: Councilmembers Cook - Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br /> Absent: None <br /> CLOSED SESSION REPORT <br /> The City Attorney reported that the City Council met in Closed Session to discuss pending <br /> litigation of Lin vs. the City of Pleasanton. The Council unanimously voted to defend against the <br /> lawsuit and to retain the law firm of Meyers Nave to aid in that defense. <br /> AGENDA AMENDMENTS — None <br /> CONSENT CALENDAR <br /> Administrative Services <br /> 1. Approved as corrected regular and special meeting minutes of August 17, 2010 <br /> Councilmember Thorne requested amendment to page 5, stating he was credited with <br /> statements which were not his. He also asked that Measure "B" be reflected as Measure <br /> "V" which is reflected at the end of that same page. <br /> City Manager <br /> 2. Accepted Commissioner Absences Report for the period January 1 through June 30, 2010 <br /> 3. Ratified Amendments No. 1 and 2 to the professional services agreement with MacKay <br /> and Somps in the amounts of $50,080 and $144,924 (for a total of $195,004) for the <br /> design services and preparation of construction documents for the plaza and garden areas <br /> between the Arts Center and Lions Wayside Park, and to provide construction <br /> administration for said areas; Amendment No. 1 to the professional services agreement <br /> with O'Connor Construction Management Inc. in the amount of $79,115 to provide ongoing <br /> construction management services of the Firehouse Arts Center: Amendment No. 2 to the <br /> professional services agreement with ELS Architecture and Urban Design in the amount of <br /> $83,548 from the Arts Center project (CIP NO. 038011) for additional design and <br /> construction administration services; Construction change contract with W.A. Thomas <br /> Company, Inc. in the amount of $1,540,909 to construct the Arts Center parking lot, plaza <br /> and garden areas; Authorize the transfer of $1,852,120 from the current Downtown <br /> Parking- Corridor project (CIP No. 018044) and the transfer of $614,962 of the remaining <br /> contingency from the Firehouse Arts Center project (CIP No. 038011) to a new Capital <br />
