RESOLUTION NO. 10-401 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO TAKE PROCEEDINGS FOR THE PROPOSED REORGANIZATION NO. 149 (STAPLES RANCH) PURSUANT TO THE CORTESE - KNOX - HERTZBERG LOCAL GOVERNMENT REORGANIZATION ACT OF 2000 WHEREAS, the City of Pleasanton desires to initiate proceedings pursuant to the Cortese - Knox - Hertzberg Local Government Reorganization Act of 2000, Division 3, commencing with Section 56000 of the California Government Code, for the reorganization of approximately 162 acres, Reorganization No. 149 (Staples Ranch), and requests initiation of proceedings thereon; and WHEREAS, the territory proposed to be annexed /detached is uninhabited, and a description of the boundaries of the territory is set forth in Exhibit "A ", attached hereto and by this reference incorporated herein; and WHEREAS, the City of Pleasanton will be the lead applicant for this proposed reorganization affecting the City of Pleasanton and the City of Livermore, and WHEREAS, this reorganization will consist of: annexation of territory to the City of Pleasanton and annexation of territory to the City of Livermore; detachment of area from the City of Livermore; detachment of area from the City of Pleasanton for the Fire District, Library District, and the Livermore Area Recreational and Park District; and an amendment to the sphere of influence for both jurisdictions; and WHEREAS, this proposal is not consistent with the sphere of influence of the affected cities; and the City of Pleasanton and the City of Livermore are initiating an amendment to the sphere of influence to coincide with the proposed boundaries; and WHEREAS, the reasons for this proposed reorganization are as follows: This is a logical extension of the City limits and the City of Pleasanton should have control over the development of this property. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. The Local Agency Formation Commission of Alameda County is hereby requested to take proceedings for reorganization of territory as described in Exhibit "A ", according to the terms and conditions stated above and in the manner provided by the Cortese - Knox- Hertzberg Local Government Reorganization Act of 2000. SECTION 2. This resolution shall become effective immediately upon its passage and adoption. SECTION 3. City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions.
