4.3 Any time the services of an appraiser or other <br /> appropriate professional are required by this Note, the Borrower <br /> shall use an appraiser or other professional approved by Lender <br /> and pay for the services of such appraiser or professional. <br /> 4.4 The purchase price shall be the price paid by the <br /> Borrower to the seller for the Property which secures this <br /> promissory note. The sales price shall be the price paid by the <br /> purchaser to the Borrower for the Property which secures this <br /> promissory note. Both purchase price and sales price shall mean <br /> the price on which the transfer tax is paid; except if the <br /> purchaser assumes existing loans or buys the Property subject to <br /> existing loans, the principal amount owing on such existing loans <br /> shall be added to the price on which the transfer tax is paid in <br /> determining the sale price. <br /> 5.0 If any monthly installment or a required payment of <br /> principal and interest under this Note is not paid when due and <br /> remains unpaid for a period of three (3) full months, after <br /> application of any partial payments which may have been accepted <br /> but not yet applied to the mortgage account, the entire principal <br /> amount outstanding, accrued interest thereon and any other <br /> amounts described in this Note, shall at once become due and <br /> payable at the option of the Lender. The Lender may exercise <br /> this option to accelerate during any default by Borrower <br /> regardless of any prior forbearance. If suit is brought to <br /> collect this Note, the Lender shall be entitled to collect all <br /> reasonable costs and expenses of suit, including, but not limited <br /> to, reasonable attorneys' fees. <br /> 6.0 Borrower shall pay to the Lender a late charge of five <br /> percent (5 %) of any monthly installment not received by the <br /> Lender within fifteen (15) days after the installment is due. <br /> 7.0 Notice of dishonor or protest are hereby waived by all <br /> makers, sureties, guarantors and endorsers of this Note. This <br /> Note shall be the joint and several obligation of all makers, <br /> sureties, guarantors and endorsers, and shall be binding upon <br /> them and their successors and assigns. <br /> 8.0 Any notice to Borrower provided for in this Note shall <br /> be given by mailing such notice by certified mail addressed to <br /> Borrower at the Property Address stated below, or to such other <br /> address as Borrower may designate by notice to the Lender. Any <br /> notice to the Lender shall be given by mailing such notice by <br /> - 5 - <br />
