D RA FT ATTACHMENT 3 <br /> PRZ -57 (PUD- 81- 30- 45M/PUD- 85- 08 -19M), City of Pleasanton <br /> Application to amend the zoning for three sites in Hacienda Business Park by <br /> removing Section 5 (PUD Modification Contingency) from Ordinance 1998 to <br /> allow the submittal of development applications consistent with the Settlement <br /> Agreement approved by the City Council on August 17, 2010 in the Case of Urban <br /> Habitat v. City of Pleasanton. The three sites are: (1) the W.P. Carey site at the <br /> southeast corner of Owens Drive and Willow Road (Assessor's Parcel No. 941- <br /> 2778- 013 -00 and part of APN 941 - 2778 - 012 -00); (2) the BRE site at the north corner <br /> of Hacienda Drive and Gibraltar Drive (APN 941 - 2778 - 011 -00); and (3) the Roche <br /> Molecular Systems site, south of Gibraltar Drive between Willow Road and <br /> Hacienda Drive (a portion of APN 941 - 2761 - 003 -00). <br /> THE PUBLIC HEARING WAS OPENED. <br /> There were no speakers. <br /> THE PUBLIC HEARING WAS CLOSED. <br /> Commissioner Pentin moved to recommend that the City Council repeal Section 5 <br /> from Ordinance No. 1998 to amend the zoning for three sites in Hacienda <br /> Business Park. <br /> Commissioner Pearce seconded the motion. <br /> ROLL CALL VOTE: <br /> AYES: Commissioners Blank, O'Connor, Pearce, Pentin, and Olson. <br /> NOES: None. <br /> ABSTAIN: None. <br /> RECUSED: None. <br /> ABSENT: Commissioner Narum. <br /> Resolution No. PC- 2010 -31 recommending approval of Case PRZ -57 (PUD- 81- 30 -45M/ <br /> PUD- 85- 08 -19M) was entered and approved as motioned. <br /> EXCERPT: PLANNING COMMISSION MINUTES, September 15, 2010 Page 1 of 1 <br />
