CITY COUNCIL OF THE CITY OF pLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1171 AN ORDINANCE OF THE CITY OF PLEASANTON AMENDING TITLE I OF THE pLEASANTON MUNICIPAL CODE BY THE ADDITION OF SECTION 1-1.20 WHICH DECLARES ANY USE CONTRARY TO THE pLEASANTON MUNICIPAL CODE OR ANY CONDITION IMPOSED pURSUANT THERETO TO BE A PUBLIC NUISANCE ENFORCEABLE BY AN INJUNCTION BROUGHT BY THE CITY OR ANY AFFECTED PROPERTY OWNER OR OCCUPANT THE CITY COUNCIL OF THE CITY OF pLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Chapter 1 (General provisions) of Title I (Administration) of the Pleasanton Municipal Code is hereby amended by the addition of a new section to be numbered and to read as follows: "§1-1.20 Injunctive Relief a. Any use of property contrary to the provisions of the pleasanton Municipal Code or any condition of a permit imposed pursuant to this code shall be, and is hereby declared to be unlawful and a public nuisance. In any action with regard to such use, the City may apply to any Court having jurisdiction for any relief as will abate or remove such use and restrain any person, firm or corporation from using any property contrary to the provisions of this Code. b. The pleasanton Municipal Code may be enforced by an injunction issued out of the Superior Court upon suit by the City or the owner or occupant of any real property affected by such violation or prospective violation." Section 2: This ordinance shall be published one within fifteen (15) days after its adoption in "The Valley Times" a newspaper of general circulation published in the City of pleasanton. Section 3: This ordinance shall be effective thirty (30) days after the date of its final passage and adoption.
