MINUTES <br /> CITY OF PLEASANTON <br /> SPECIAL CITY COUNCIL MEETING <br /> September 7, 2010 <br /> 1. CALL TO ORDER <br /> Mayor Hosterman called the special meeting to order at the hour of 6:15 p.m. <br /> 2. ROLL CALL <br /> Present: Councilmembers Cook- Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br /> Absent: None <br /> 3. PUBLIC COMMENT <br /> Allen Roberts referenced a letter from his attorney that was hand delivered to the City earlier <br /> today concerning the volatility of "poison pill" set forth in Ordinances approving the Development <br /> Agreement and Planned Unit Development for Oak Grove. He said the voters fully expected the <br /> Development Agreement to be invalidated when they voted no on Measure D in the June election <br /> and that it is the Council's duty and obligation to follow the law and bring its voters' intent to <br /> fruition. <br /> Kay Ayala agreed with Mr. Robert's comments. <br /> The meeting adjourned to closed session at 6:25 p.m. for the following purpose. <br /> 4. CONFERENCE WITH LEGAL COUNSEL — EXISTING LITIGATION pursuant to Government <br /> Code §54956.9(a): - Continued from August 24, 2010 — Lin v. City of Pleasanton, Alameda <br /> County Superior Court, Case No. RG- 10- 519153 <br /> 5.
