MINUTES <br />CITY OF PLEASANTON <br />SPECIAL CITY COUNCIL MEETING <br />August 26, 2010 <br />1. CALL TO ORDER <br />Mayor Hosterman called the special meeting to order at the hour of 4:30 p.m. <br />2. ROLL CALL <br />Present: Councilmembers Cook- Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br />Absent: None <br />3. PUBLIC COMMENT <br />Karen Martens noted the contributions made by the Oak Grove Developer James Tong to the <br />Mayor's campaign committee and expressed concern with the perception of a conflict. <br />Pat Murray asked when the notices for this meeting were posted. She expressed concern that the <br />outcome of the votes cast by the citizens concerning the Oak Grove project are being disregarded <br />by the lawsuit filed by the projects property owners. <br />Kay Ayala urged the Council to have a public session on this matter to afford the citizens the <br />opportunity to understand how each Councilmember feels about the issue. <br />Howard Neely felt the focus should be put back on what the community is all about and noted the <br />importance of proper owner rights. <br />Sharrell Michelotti referred to the pride Pleasanton places on being a Community of Character <br />and felt it was lost in the process as it relates to Oak Grove. She said members of the community <br />are elected to lead the city and that she respects their judgment and the decisions made by <br />Council. <br />In response to Ms. Murray's question, Mayor Hosterman asked the City Clerk to respond. <br />City Clerk Karen Diaz explained that special meetings require a 24 -hour notice and that notice <br />was posted Monday, August 23 on the bulletin boards at 123 Main Street and 200 Old Bernal as <br />well the City's Website. In addition, the Notice was emailed to the local newspapers and to <br />subscribers on agenda email distribution list. <br />The meeting adjourned to closed session at 4:50 p.m. for the following purpose. <br />4. CONFERENCE WITH LEGAL COUNSEL — EXISTING LITIGATION pursuant to Government <br />Code §54956.9(a): - Lin v. City of Pleasanton, Alameda County Superior Court, Case No. RG -10- <br />519153 <br />5.
