ORDINANCE NO. 2005 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING <br />THE APPLICATION OF PLEASANTON GATEWAY, L.L.C. (SCOTT TROBBE) FOR A SEVEN <br />YEAR EXTENSION OF THE DEVELOPMENT AGREEMENT (PDAM -03) BETWEEN THE CITY <br />AND PLEASANTON GATEWAY REGARDING ITS EIGHT - BUILDING OFFICE <br />DEVELOPMENT TOTALING 745,000 SQUARE FEET ON AN APPROXIMATELY 39.22 -ACRE <br />SITE AT 6750 BERNAL AVENUE <br />WHEREAS, Pleasanton Gateway, L.L.C., has applied for a seven (7) year extension of <br />the Development Agreement for its property at 6750 Bernal Avenue regarding an eight - building <br />office development totaling 745,000 s.f. on an approximately 39.22 -acre site; and <br />WHEREAS, the Pleasanton Gateway property is located on a portion of the 516 -acre <br />Bernal Property Specific Plan area, Planned Unit Development (PUD) Plan area, and which was <br />studied in the Bernal Property Environmental Impact Report; and <br />WHEREAS, zoning for the Pleasanton Gateway property is Planned Unit Development <br />— Commercial (PUD -C) District; and <br />WHEREAS, at its meeting of August 17, 2010, the City Council received information in <br />the staff report, testimony from members of the public, the Planning Commission's finding from <br />its May 12, 2010 meeting that the requested extension is consistent with the Pleasanton <br />General Plan and the Bernal Property Specific Plan, and the recommendation for approval of <br />the Development Agreement extension; and <br />WHEREAS, the physical environment of the Pleasanton Gateway property has not <br />significantly changed since the Bernal Property Final EIR was approved for the Bernal Property <br />Specific Plan and Planned Unit Development (PUD) zoning, including the Pleasanton Gateway <br />project in , and the extension of the Development Agreement does not modify the approved <br />Pleasanton Gateway project; and <br />WHEREAS, after a review of the materials and consideration of the testimony <br />presented, the City Council determines that the proposed Development Agreement extension <br />(PDAM -03) is consistent with the Pleasanton General Plan and with the Bernal Property <br />Specific Plan. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Approves Case PDAM -03, the request of Pleasanton Gateway, LLC, to <br />extend its Development Agreement with the City of Pleasanton for an additional seven (7) <br />years, as generally set forth in Exhibit A, attached here and incorporated herein by reference. <br />SECTION 2. Directs the City Manager to execute the Amendment to Development <br />Agreement to provide for the seven (7) year extension, as generally set forth in Exhibit A. <br />SECTION 3. A summary of this ordinance shall be published once within fifteen (15) <br />days after its adoption in "Valley Times," a newspaper of general circulation published in the <br />City of Pleasanton, and the complete ordinance shall be posted for fifteen (15 days) in the City <br />Clerk's office within fifteen (15) days after its adoption. <br />
