Councilmember <br /> McGovem said this is the area of greatest interest to the public and asked staff to ensure they <br /> are aware it has not been eliminated. Mr. Fialho clarified that it may not rise to the level of an <br /> EIR but would involve significant environmental review to allow the Council to make a <br /> determination as to whether or not it is in conformance with the current General Plan. He also <br /> noted that while the Council is obligated to consider and act on any application that comes — <br /> forward, much of this is market driven. He said it is possible, while there is a motivated task <br /> force and set of property owners, it could be a number of months or .even years before the <br /> Council sees a project. <br /> Councilmember McGovern asked if the Planning Commission or Council has the ability to add <br /> to the non -core standards identified by the task force. Mr. Fialho confirmed, provided they do <br /> not make the core standards infeasible. <br /> Mr. Bocian stated staff is recommending the Council direct the City Manager to execute the <br /> Tentative Agreement; authorize Mr. Lowell to prepare the settlement agreement; direct the City <br /> Manager to place the agreement on the August 17, 2010 City Council agenda; approve the <br /> attached resolution approving enhancements to the existing Non - Discrimination Housing <br /> Policies; and authorize staff to begin preparing documents consistent with the Tentative <br /> Agreement and Settlement Terms Sheet. <br /> Mayor Hosterman opened the hearing to public comment. <br /> Public Comments: <br /> Patricia Belding, Citizens for a Caring Community (CCC), said her organization would like to <br /> congratulate the Council on settling this suit. Taking this action shows vision and leadership and <br /> the activities being undertaken to rezone Hacienda are commendable. She said this is a fine <br /> first step to bringing housing closer to jobs and CCC looks forward to working with the City on a ^, <br /> new Housing Element that will secure sustainability and social justice. <br /> Kay Ayala said the citizens should be aware they are losing local control and will have to rely on <br /> the Council to retain the two -time voter approved housing cap. She said $1.9 million that could <br /> have been used to subsidize affordable housing has been lost to the pockets of lawyers. She <br /> stated that three Councilmembers are up for re- election and those same three sided with the <br /> developer in the matter of local control. She asked each to explain to the public why they should <br /> be trusted following those actions. <br /> Cliff Rechtschaffen, California Attorney General's office, urged the Council to vote in support of <br /> the Tentative Agreement. He complimented Mayor Hosterman and Councilmember McGovern <br /> on their exemplary leadership throughout the settlement process and City staff for their hard <br /> work and consummate professionalism. He said that to the great credit of the City, leaders <br /> decided to roll up their sleeves and work out a settlement that makes sense for everyone. He <br /> thought that with this agreement, Pleasanton would assume a leadership role throughout the <br /> state on how to grow sustainably, while retaining the special character and feel of a local <br /> community. He said residents can be proud of this agreement and again requested the <br /> Council's support. <br /> Mayor Hosterman said every single party to this action was ready to roll up their sleeves and <br /> work.
