RESOLUTION NO. 10 -385 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> AUTHORIZING PARTICIPATION IN THE LOCAL AGENCY WORKERS' <br /> COMPENSATION EXCESS JOINT POWERS AUTHORITY <br /> WHEREAS, pursuant to Government Code Section 6500 et seq., the City of Pleasanton is <br /> authorized to enter into a joint powers agreement with other public agencies; and <br /> WHEREAS, it is proposed that cities and special districts throughout California join together <br /> to create the Local Agency Workers' Compensation Excess Joint Powers Authority to provide <br /> "pooled funding" of workers' compensation insurance benefits and costs; and <br /> WHEREAS, the City of Pleasanton has decided to join and become a member of the Local <br /> Agency Workers' Compensation Excess Joint Powers Authority. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Approves and authorizes participation in the Local Agency Workers' <br /> Compensation Excess Joint Powers Authority. <br /> SECTION 2. The Joint Exercise of Powers Agreement to Establish, Operate, and Maintain <br /> a Joint Program for Workers' Compensation Excess Protection, in the form attached as Exhibit A, is <br /> hereby approved by the City of Pleasanton, and the City Manager of the City of Pleasanton is hereby <br /> authorized and directed to execute the Agreement on behalf of the City of Pleasanton. <br /> SECTION 3. The City Manager of the City of Pleasanton is also authorized to execute any <br /> other document(s) that may be necessary or appropriate to enter into and implement the Agreement <br /> and the Local Agency Workers' Compensation Excess Joint Powers Authority on behalf of the City <br /> of Pleasanton. <br /> SECTION 4. The Human Resources Manager of the City of Pleasanton is hereby <br /> appointed as the City of Pleasanton representative on the Local Agency Workers' Compensation <br /> Excess Joint Powers Authority's Governing Board, and the Assistant City Manager of the City of <br /> Pleasanton is hereby appointed as the City of Pleasanton alternate Representative on such <br /> Governing Board. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a <br /> regular meeting held on July 20, 2010. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on the 20th day of July, 2010, <br /> by the following vote: <br /> Ayes: Councilmembers McGovern, Thorne, Mayor Hosterman <br /> Noes: None <br /> Absent: Councilmembers Cook- Kallio, Sullivan <br /> /.f i7 d. <br /> Kare Diaz, City Clerk <br /> APPROVED AS TO FORM: <br /> , �— <br /> J n P.
