RESOLUTION NO. 10 -386 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />REPEALING RESOLUTION 08 -250 AND MODIFYING THE CONDITIONS OF <br />APPROVAL FOR PDR -715, A DESIGN REVIEW PERMIT FOR EXISTING <br />REAR YARD IMPROVEMENTS AT THE RESIDENCE OF 927 MONTEVINO <br />DRIVE <br />WHEREAS, in December 2007, Steve Jeffrey applied for a design review approval for <br />rear yard improvements at the existing residence located at 927 Montevino Drive; and <br />WHEREAS, at its meeting of December 2, 2008, the City Council adopted Resolution <br />08 -250 approving the design review application (PDR -715) subject to certain conditions of <br />approval; and <br />WHEREAS, Steve Jeffrey objected to two of the conditions of approval and filed suit <br />against the City of Pleasanton in Alameda Superior Court seeking to overturn the conditions; <br />and <br />WHEREAS, the City Council held a public hearing on July 20, 2010, at which time Steve <br />Jeffrey and any other member of the public were offered an opportunity to present evidence <br />regarding PDR -715; and <br />WHEREAS, after receiving public testimony and reviewing the materials presented, on <br />July 20, 2010, the City Council decided to set aside the conditions imposed by the Council on <br />December 2, 2008, and replace those conditions with new conditions of approval for PDR -715; <br />and <br />WHEREAS, after receiving public testimony and reviewing the materials presented, on <br />July 20, 2010, the City Council repealed Resolution 08 -250 and adopted this Resolution in its <br />place with new conditions of approval for PDR -715; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA) under Sections 15304(4)(a -c), Minor Alterations to <br />Land, and 15305(5), Minor Alterations in Land Use Limitations. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br />SECTION 1. Resolution 08 -250 is repealed and replaced with this Resolution. <br />SECTION 2. The design review application of Steve Jeffrey, PDR -715, is approved <br />subject to new conditions of approval and the prior conditions of approval from December 2, 2008, <br />are no longer in effect. The new conditions of approval for PDR -715 are attached hereto and <br />incorporated herein. <br />SECTION 3. This resolution shall become effective immediately upon its passage and <br />adoption. <br />1 <br />
