(Ord. 1082 § 2, <br />1983; prior code § 2- 15.50.03(g)) <br />15.20.110 Commencement of peak month <br />loading charges. <br />Peak month loading charges for every user shall <br />commence on the date the user purchases a connection <br />permit, or on the date the district's treatment and dis- <br />posal facilities are ready for use, whichever is later. <br />Peak month loading charges shall be based on the total <br />capacity purchased. The peak month loading charges <br />shall be based on unit costs for each user demand <br />charge, except for collection, as determined by the <br />director. (Ord. 1203 § 5, 1985; prior code § 2- <br />15.50.03(h)) <br />15.20.120 Connection fees and charges — <br />Generally. <br />Connection fees and charges shall be assessed <br />new users or existing users desiring expanded capacity <br />in the sewerage system. Connection fees and charges <br />shall provide for the recovery of the user's propor- <br />tional share of: <br />A. The city's and district's capital costs of the <br />sewerage system; <br />B. The cost of treatment plant expansion, im- <br />provements and rehabilitation; <br />C. The cost of repairing, replacing and ex- <br />panding the sewerage system; <br />D. The cost of purchasing capacity from an- <br />other sewerage system; and <br />E. Any other sewerage system related pur- <br />pose. (Ord. 1082 § 2, 1983; prior code § 2- 15.50.04) <br />15.20.130 Connection fee — Levied. <br />Connection fees shall be assessed new users or <br />existing users desiring expanded capacity according to <br />the schedule set forth in Section 15.20.180 of this <br />chapter. Connection fees shall be levied and are due <br />and payable to the city at the time a permit is issued <br />authorizing connection to the sewerage system. <br />A. District Connection Fee. A district connec- <br />tion fee shall be levied and collected by the city from <br />each applicant unless the applicant has paid the appro- <br />priate district connection fee directly to the district <br />pursuant to agreements entered into prior to the adop- <br />lion of this chapter. Applicants who have paid the dis- <br />trict connection fee directly to the district shall furnish <br />the city satisfactory evidence of a valid district connec- <br />tion permit at the time of application for sewerage <br />407 <br />15.20.110 <br />connection. District connection fees collected by the <br />city shall be transferred to the district monthly and <br />shall be deposited by the district in its sewer expansion <br />fund. <br />R. City Connection Fee. The city connection <br />fee shall be levied and collected by the city from each <br />applicant. City connection fees shall be deposited in <br />the sewer improvement fund. <br />C. City Connection Surcharge. In the event <br />the city has entered into any reimbursement agreement <br />or other agreement requiring the collection and /or re- <br />distribution of connection fees from all or any particu- <br />lar portion of the city, the city shall collect said con- <br />nection fees in the amount and manner as prescribed in <br />those agreements. <br />D. Exception — Reconstruction of Damaged <br />Structures. No sewer connection fee or charge shall be <br />made for the construction, rehabilitation, or repair to <br />any existing structure damaged or destroyed by a natu- <br />ral catastrophe or act of God, including, but not limited <br />lo, fires, earthquakes, and floods. <br />E. Exception--Credits. A credit against con- <br />nection fees and charges shall be permitted for all <br />lands subject to any agreement that specifically pro- <br />vides for credits or reimbursements against such fees <br />and charges. (Ord. 1082 § 2, 1983; prior code § 2- <br />15.50.04(a)) <br />15.20.140 Connection fee — Additional capacity. <br />Any change in use or addition to premises result- <br />ing in a need for greater capacity in the sewerage sys- <br />tem shall require the payment of additional fees as <br />prescribed herein. (Ord. 1082 § 2, 1983; prior code § <br />2- 15.50.04(6)) <br />15.20.150 Connection fee — Payment when. <br />Prior to the issuance of any building permit or <br />other permit authorizing connection to or additional <br />use of capacity in the sewerage system by the city, the <br />applicant therefor shall pay to the city the necessary <br />connection fees provided for in this chapter, together <br />with such other fees as may be now in effect or hereaf- <br />ter adopted. (Ord. 1082 § 2, 1983; prior code § 2- <br />15.50.04(c)) <br />15.20.160 City sewer improvement fund. <br />All revenues deposited in the sewer improve- <br />ment fund shall be used for any of the purposes de- <br />scribed in this section. Interest earned on such funds <br />shall remain in the sewer improvement fund and shall <br />be used for the same purposes as the principal.
