"Commercial unit" means any occupied <br />premises specifically utilized for the purpose of engag- <br />ing in commercial activity as defined in Chapter 18.44 <br />of this code. <br />13. `Industrial unit" means any occupied prem- <br />ises specifically utilized for the purpose of engaging in <br />industrial activity as defined in Chapter 18.48 of this <br />code. <br />C. `Refuse" means all putrescible and nonpu- <br />trescible, combustible and noncombustible solid wastes, <br />including, but not limited to, animal and vegetable waste <br />resulting from the preparation, cooking and consump- <br />tion of food, garbage, rubbish, ashes, street cleaning, <br />dead animals, solid market and industrial waste, paper <br />wrappings, cigarettes, cardboard, tin cans, yard clip- <br />pings, leaves, wood, glass, bedding, crockery and simi- <br />lar materials. <br />D. "Residential unit" means any occupied <br />premises having bathroom or toilet, and kitchen plumb- <br />ing facilities, suitable for residential occupancy by a <br />number of persons living together as a single- family, <br />including single - family dwellings, and each group of <br />occupied rooms constituting living quarters for a single <br />family in any duplex, triplex, apartment, court or other <br />multiple dwelling structure, by excluding any living or <br />sleeping quarters in hotels, apartments, roominghouscs, <br />motels or auto courts where kitchen facilities are not <br />provided. (Prior code § 4 -4.04) <br />9.20.020 General provisions. <br />Each and every "residential unit ", "commercial <br />unit" and "industrial unit," as defined in Section <br />248 <br />9.20.010 of this chapter, shall have garbage service by <br />the refuse collector of the city. To provide such service, <br />the city may grant a franchise for the exclusive right to <br />collect, transport and dispose of refuse produced and <br />accumulated within the limits of the city as provided in <br />this chapter. (Prior code § 4 -4.05) <br />9.20.030 Refuse service. <br />A. The city manager, or the community devel- <br />opment director, shall cause all buildings or structures <br />specified in Section 9.20.020 of this chapter within the <br />corporate limits of the city to be visited from time to <br />time, and the sanitary condition of the buildings or struc- <br />tures examined to determine whether the provisions of <br />this chapter are complied with. Upon notification by a <br />duly authorized representative of the city, all persons, <br />including the refuse collector, shall comply with the <br />provisions of this chapter or be deemed guilty of a mis- <br />demeanor. <br />B. In all cases of disputes or complaints con- <br />cerning receptacles for refuse and the place where they <br />are awaiting removal of their contents, the quantities to <br />he removed, the number of times of removal, and the <br />rates charged, the city manager or the community devel- <br />opment director, or their duly authorized agent, shall <br />designate the place, quantity, time, manner and rates for <br />such removal, and his or her decision shall be final. <br />C. It is unlawful for any person to in any man- <br />ner interfere with the collection, removal or disposal of <br />refuse by the authorized refuse collector. <br />D. No person, firm or corporation shall dump, <br />place or bury in any lot, land, street, alley or other public <br />place, or in any waterway or elsewhere m the corporate <br />limits, any garbage, trash, rubbish, manure or waste mat- <br />ter condemned by the city manager or community de- <br />velopment director. <br />E. No refuse shall be burned within the city <br />limits unless such burning complies with the then exist- <br />ing ordinance of the city which regulates such burning. <br />(Ord. 2000 § 1, 2009; prior code § 4 -4.06) <br />9.20.040 Private permits for garbage removal. <br />Every owner or person in possession of any build- <br />ing or structure for which garbage removal is required, <br />shall have the right to remove the same, but it is unlaw- <br />ful for any person to regularly remove garbage from <br />more than one residential unit. No person other than the <br />refuse collector of the city shall regularly move any gar- <br />bage over any of the streets of the city without obtaining <br />a permit to do so. Such permits shall be issued by the <br />city clerk, on application therefor, and on payment of the <br />
