§ 5-9.10 Permissible Types of Newsracks. <br /> <br /> a. Multi-Unit Configurations. Newsracks in a mUlti-unit <br /> configuration standard in trade use permanently affixed <br /> to the ground in a manor confdrming to a standard detail <br /> for permanent installation of newsracks as established <br /> by the Director of Public Works shall be required or <br /> permitted as follows: <br /> <br /> (1) Historical Business District. In r~cognition <br /> 0'f the unique architectural features and basic <br /> heritage theme-of the area bounded by the <br /> westerly right-of-way line of Peters Street on <br /> the West, First Street on the east, the Western <br /> Pacific railroad track on the north and Bernal <br /> Avenue on the south, which in this Article shall <br /> be designated the Historical Business District <br /> (HBD), all newsracks located within the HBD shall <br /> be of a multi-unit configuration. <br /> <br /> (2) Areas Outside the HBD. Multi-unit configurations <br /> Sh'a%l be permitted in areas outside the HBD but <br /> are not required. <br /> <br /> b. Single-Unit Configurations. Any single newsrack of <br /> ~'ta~dard design commonly in trade use may be either <br /> movable or permanently affixed.to the ground in the <br /> following circumstances: <br /> <br /> (1) Notwithstanding Section 5-9.10(a) above, in any <br /> single location in the HBD for a period of sixty <br /> (60) days in order to determine the suitability <br /> of long-term newsrack locations. <br /> <br /> (2) In any location outside the HBD. <br /> <br /> Single-unit newsracks shall not be chained, bolted, <br /> or otherwise attached to any property not owned by <br /> the owner of the newsrack without the consent of <br /> the owner of the property. Single-unit newsracks <br /> shall not be chained, bolted, or otherwise attached <br /> to any tree, shrub, or other plant nor situated <br /> upon any landscaped area. <br /> <br /> c. Permissible.Height.. and Arrangement. The height of <br /> any newsrack shall be no greater than five (5) <br /> feet measured from the ground to the top surface <br /> of ~he newsrack.
