CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1147 AN ORDINANCE AMENDING ARTICLE 5 (NEWSRACKS AND SIMILAR DISPENSERS) OF CHAPTER 8, TITLE V OF THE ORDINANCE CODE OF THE CITY OF PLEASANTON WHEREAS, on October. 25, 1983, the City Council adopted Ordinance No. 1103, comprehensively regulating newsracks within the City of Pleasanton but delaying implementation for six months; and WHEREAS, opposition to certain portions of the ordinance by newspaper distributors led to a 45-day extension of the operative date to enable the City and the distributors to work out their differences and avoid potential litigation; and WHEREAS, the City and newspaper distributors have agreed to regulate newsracks through a combination of ordinance and agreement, necessitating changes to be made to Ordinance No. 1103; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Article 5 (Newsracks and Similar Dispensers) of Chapter 8, Title V of the Ordinance Code of the City of Pleasanton is hereby amended in its entirety to read as set forth in Exhibit "A", attached hereto and incorporated herein by this reference. Section 2: Severability. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the ordinance. The City Council of the City of Pleasanton hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more other sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 3: Publication. This ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton.
