3.9 Master Map/Building Permits. Within thirty (30) days following City's approval <br /> of the Specific Plan and the PUD, Property Owner shall submit an application for approval of a <br /> Master Vesting Tentative Map (the "Master Map'). Provided the Master Map substantially <br /> conforms to the Specific Plan and the PUD, the City shall review and approve the Master Map in <br /> accordance with the Master Map/Building Permit Schedule attached hereto as Exhibit "E" and <br /> incorporated herein by reference (the "Master Map/Building Permit Schedule and such review <br /> and approval shall be considered an administrative approval subject only to conditions that are <br /> consistent with the Specific Plan and PUD. In addition, City shall review and approve all final <br /> maps "Final Maps all subdivision agreements, all subdivision improvement plans and issue <br /> initial building permits in accordance with the Master Map/Building Permit Schedule. With <br /> respect to City's review and approval of Property Owner's building plans and the issuance of <br /> building permits, City shall review and approve plans and issue building permits in accordance <br /> with the Master Map/Building Permit Schedule. <br /> 3.10 Storm Drainage. City acknowledges that the Property Owner has designed the <br /> Project to incorporate the Arroyo setbacks requested by the Alameda County Flood Control and <br /> Water Conservation District Zone 7 "Zone 7") in Zone 7's letter addressed to the City of <br /> Pleasanton dated June 21, 1999. Property Owner shall not be responsible for any improvements <br /> that may be required within or along the Arroyo setback areas. City also acknowledges that, as <br /> shown in the Initial Project's Approvals, the storm drainage system for the Project and the Public <br /> Parcel incorporates the use of detention basins that will be located in the Public Parcel and that <br /> such detention basins shall be owned and maintained by the City. <br /> 3.11 CC000eration in Establishine Assessment Districts. City shall cooperate in the <br /> formation, including the issuance of bonds therefor, of assessment districts, community facilities <br /> districts or other land secured financing mechanisms (collectively, the "Assessment Districts to <br /> fund improvements associated with development of the Property, or any portion thereof, <br /> including the formation of Assessment Districts under joint powers agreements and other joint <br /> arrangements to accomplish economies of scale and cost savings. To the extent an Assessment <br /> District is formed which creates an assessment obligation against for -sale, single family <br /> residential lots in the Project. the assessment obligation shall be required to be satisfied at or <br /> prior to close of escrow for the sale of the individual lot against which the assessment is charged. <br /> 3.12 Sewer Reservation. City shall reserve, guarantee and supply sufficient sewer <br /> treatment and disposal capacity for the Project necessary to meet Project needs consistent with <br /> the scope of development and uses contemplated under the Initial Project Approvals. Such <br /> reservation, guarantee and supply shall be consistent with the growth management allocations <br /> and timing of said allocations as provided in the Growth Management Agreement and shall be <br /> consistent with the commercialloffice density authorized under the Project Approvals. Prior to <br /> securing a long tenn source for sewer treatment and disposal capacity through the Livermore <br /> Amador Valley Water Management Agency (LAVWMA) or otherwise, City shall reserve, <br /> guarantee and supply sufficient sewer treatment and disposal capacity for the Project necessary <br /> to meet the interim demands of the Project. <br /> 3.13 Traffic Reports. In order to reserve traffic capacity for the Project, upon the <br /> Initial Project Approvals, City shall include in its baseline traffic reports traffic trips from the <br /> Project as if the Project were built. <br /> 35690/849315vl4 17 08/25/00 <br />
