CONDITIONS OF APPROVAL <br /> PDR -715, Steve Jeffrey <br /> 927 Montevino Drive <br /> July 20, 2010 <br /> 1. All Conditions of Approval of PAP 127 /PDR -715, as approved by the City Council <br /> on December 2, 2008, are no longer in effect. The conditions of approval set <br /> forth below are meant to replace the conditions from December 2, 2008. <br /> 2. All Conditions of Approval of Tract 5835 shall remain in full force and effect <br /> except as modified by the conditions below. <br /> 3. In June 2010, the City's Landscape Architect prepared a Landscape Plan which <br /> details the location, size, and species of all of the landscape materials located <br /> within the rear twenty -five feet of the Jeffrey's yard. See Exhibit 1 "Landscape <br /> Plan" attached. The Landscape Plan identifies those trees and plants already in <br /> existence (i.e., planted by the Jeffreys in 2008) as well as new trees and plants to <br /> be installed by the Jeffreys as part of this approval. The Jeffreys shall install the <br /> new trees and plants within 30 days of this approval. <br /> 4. The Jeffreys, and any successors in interest, shall irrigate and maintain the <br /> landscaping shown in the Landscape Plan. <br /> 5. The Jeffreys, and any successors in interest, shall not remove or modify the <br /> landscaping identified in the Landscape Plan except as provided in this Condition <br /> Number 5. If a plant or tree fails, dies, or becomes diseased, the Jeffreys (or <br /> their successor in interest) must promptly remove and replace the plant or tree <br /> with the same species that was removed. No City approval is required. <br /> However, if the Jeffreys, or any successors in interest, wish to change or remove <br /> any landscaping within the Landscape Plan (for any reason other than failure, <br /> death, or disease), such changes or removal must first be approved by the City's <br /> Community Development Director or his or her designee. In considering a <br /> request to remove or alter the landscaping, the Community Development Director <br /> must ensure that the new or modified landscaping provides equal or better <br /> privacy screening to the rear neighbors. <br /> 6. The Jeffreys' lot is encumbered by two easements shown in Exhibit 2, attached. <br /> Exhibit 2 consists of three pages. The first page shows the easements included <br /> as part of the Tract Map. (See lot 4). The second and third pages are aerial <br /> photographs taken in May 2005 and October 2009 and are included to show the <br /> approximate location of the two easements. The Jeffreys, and any successors in <br /> interest, shall not be permitted to build or install any new improvements within <br /> these two easement areas, including but not limited to gazebos, trellises, sheds, <br /> sports courts, decks, play structures, etc. <br /> Page 3 of 4 <br />
