ATTACHMENT 1 <br /> THE CITY OF <br /> FL€ASANTONO <br /> 1S Amendment to Joint Use Agreement <br /> Veterans Memorial Building at 301 Main Street <br /> This amended Agreement is made and entered into this day of July, 2010 by the City of <br /> Pleasanton, a Municipal Corporation and general law city "City") and American Legion Post 237, <br /> VFW Post 6298, VFW Post 6298 Ladies' Auxiliary, and Air Force Association Chapter 120 collectively <br /> known as the Veterans Organizations of Pleasanton (VOP) and replaces the former Joint Use Agreement <br /> dated 15th day of March, 2005. <br /> RECITALS <br /> A. In 1932, the County of Alameda constructed the Pleasanton Veterans Memorial Building located at <br /> 301 Main Street, Pleasanton, California "Facility <br /> B. On April 3, 1973, the City of Pleasanton entered into an Agreement with Alameda County <br /> regarding the Facility and agreed to operate it in accordance with the Military and Veterans Code <br /> Section 1260, et seq. for the use or benefit of "Veterans' associations," as defined in Section 1260, <br /> and to provide space for City- sponsored educational, social and recreational functions. <br /> C. In 1997, the City of Pleasanton assumed ownership of the Facility and underlying land, and <br /> indicated its intention to retain this ownership. <br /> D. Pursuant to Resolution No. 97 -01, dated January 7, 1997, the City accepted the transfer of title to <br /> the Facility under Military and Veterans Code Section 1262, providing that the Facility would be <br /> used for a variety of City recreational activities, social events, meals programs, City offices and <br /> meetings, which would not unduly interfere with the continued access to and reasonable use of the <br /> building by the Veterans. <br /> E. Pursuant to Resolution No. 05 -201, dated April 19, 2005, the City Council approved a Joint Use <br /> Agreement between the American Legion Post 237, VFW Post 6298, VFW Post 6298 Ladies' <br /> Auxiliary, collectively known as the Veterans Organizations of Pleasanton (VOP) for joint use of <br /> the Veterans Memorial Building. <br /> F. In 2007, the City renovated the Facility making it compliant with Federal, State and City building <br /> codes and requirements. After three (3) years of operating the Facility under the current Joint Use <br /> Agreement, a new agreement is required to address operational changes and requirements. <br /> Amended July 2010 <br />
