BACKGROUND <br /> In 1932, the County of Alameda constructed the Pleasanton Veterans Memorial Building <br /> located at 301 Main Street, Pleasanton, California "Facility <br /> On April 3, 1973, the City of Pleasanton entered into an Agreement with Alameda <br /> County regarding the Facility and agreed to operate it in accordance with the Military <br /> and Veterans Code Section 1260, et seq. for the use or benefit of "Veterans' <br /> associations," as defined in Section 1260, and to provide space for City- sponsored <br /> educational, social, and recreational functions. <br /> In 1997, the City of Pleasanton assumed ownership of the Facility and underlying land, <br /> and indicated its intention to retain this ownership. Pursuant to Resolution No. 97 -01, <br /> dated January 7, 1997, the City accepted the transfer of title to the Facility under Military <br /> and Veterans Code Section 1262, providing that the Facility would be used for a variety <br /> of City recreational activities, social events, meals programs, City offices and meetings, <br /> which would not unduly interfere with the continued access to and reasonable use of the <br /> building by the Veterans. <br /> Pursuant to Resolution No. 05 -201, dated April 19, 2005, the City Council approved a <br /> Joint Use Agreement between the American Legion Post 237, VFW Post 6298, VFW <br /> Post 6298 Ladies' Auxiliary, collectively known as the Veterans Organizations of <br /> Pleasanton (VOP) for joint use of the Veterans Memorial Building. <br /> In 2007, the City renovated the Facility making it compliant with Federal, State, and City <br /> building codes and requirements, which warrants a new agreement to address <br /> operational changes and requirements. <br /> DISCUSSION <br /> On February 23, 2010, staff presented the amended Joint Use Agreement to the <br /> Veterans Organizations of Pleasanton (VOP) for review and comment. At that meeting <br /> it was requested that the Air Force Association Chapter 120 be included into the VOP; <br /> that the language in Item 5 Joint Use of the Facility be made clearer, defining "Veteran's <br /> related activities /meetings." The language: "The parties agree to cooperate in the joint <br /> use of the Facility to maximize its value to the community and the VOP for Veterans' <br /> related activities/meetings, which must meet the following criteria: events must be <br /> approved by a majority vote of a quorum of each Veterans' association, Veterans must <br /> be present at the event at all times, event must be a direct benefit to the Veterans' <br /> association, and co- sponsored events must serve a Veterans' association in a positive <br /> manner. Adjustments to these procedures may be mutually agreed upon in a written <br /> document, signed by the VOP and the Director of Parks and Community Services. "was <br /> discussed, reviewed, and approved by the VOP. <br /> Additional changes include the addition of Item 6 Banners Displayed, the language in <br /> Item 11 Subleasing and Non Assignability was strengthened for clarity, and Item 16 <br /> Page 2 of 3 <br />
