of that report on recent litigation, as well as the fact that these issues have been frequently introduced in <br /> Sacramento, but then often languish in committee without further action. <br /> However, since one bill (AB 1998 Brownley) recently has been passed by the Assembly (and sent to the <br /> Senate Rules Committee for assignment), the following is a summary of current legislation also under <br /> consideration: <br /> Assembly Bill 68 (Brownley). Mandate that grocery stores and retail stores 10,000 square feet <br /> and larger with a pharmacy charge $0.25 for each disposable plastic bag that customers [except <br /> those paying with food stamps or in Women Infant Children (WIC) programs] request, starting on <br /> July 1, 2010. <br /> Assembly Bill 87 (Davis). Mandate a $0.25 fee on single -use plastic bags provided at grocery <br /> stores and retail stores 10,000 square feet and larger with a pharmacy starting on July 1, 2010. <br /> Assembly Bill 1141 (Calderon). Not allow local agencies prohibiting single use plastic bags from <br /> receiving certain State funds from the California Integrated Waste Management Act. Have the <br /> Integrated Waste Management Board adopt a 50% recycling goal; and impose a $0.001 <br /> manufacturing fee on plastic bags. <br /> Assembly Bill 1998 (Brownley). Prohibits grocery stores, retailers with over 10,000 s.f. with <br /> pharmacy, food marts or convenience stores with liquor license, from providing single -use plastic <br /> bags; require such retailers to charge at least $0.05 for a recyclable paper bag [except for food <br /> stamp and WIC customers]; starting January 1, 2012. The bill also specifically pre -empts local <br /> legislation about single -use bags, reusable bags, and recycled paper bags; except allows San <br /> Francisco's compostable plastic bag program. <br /> Assembly Bill 2138 (Chesbro) Ban single use foam food take -out containers starting July 1, <br /> 2011; and instead require compostable or recyclable.
