"Landscape Design Guidelines for the Yee Property dated April, 2007, prepared <br /> by PGAdesign, Inc. <br /> Minor changes to the development plan may be allowed subject to the approval of the <br /> Director of Community Development if found to be in substantial conformance to the <br /> approved exhibits and in conformance to the CEQA determination. <br /> 2. Unless otherwise specified by the following conditions, the applicant shall obtain all <br /> agency environmental permits that this development is subject to prior to the recordation <br /> of the parcel map or prior to the issuance of a grading permit and shall obtain any other <br /> applicable City permits prior to the commencement of any construction, or as reviewed <br /> and approved by the Planning Division and City Engineer. <br /> 3. The applicant shall pay any and all fees to which the property covered by this PUD <br /> development plan approval is subject to as provided in these conditions of approval or <br /> prior to approval of parcel map. Owners of residential lots shall pay all applicable <br /> building permit fees for the individual lots at the time of issuance of building permit(s). <br /> The type and amount of the fees shall be those set forth in these conditions or in effect <br /> at the time the fees are otherwise paid. <br /> 4. All conditions of approval for this development plan shall be reprinted and included as a <br /> plan sheet(s) with the improvement plan check sets including grading, improvement/ <br /> construction, and landscaping plans, which shall be kept on the project site at all times. <br /> The applicant may request these conditions of approval be attached to the plan set as a <br /> separate document which he /she is responsible for obtaining and ensuring the <br /> conditions are securely attached. Prior approval from the Planning Division is required <br /> before any changes are constituted in site design, grading, etc. It is the responsibility of <br /> the applicant to ensure that the project contractors are aware of, and abide by, the <br /> approved plans and all conditions of approval. A modified form of this condition shall be <br /> incorporated in the design guidelines. <br /> 5. This PUD development plan modification shall be of no further validity and the applicant <br /> shall be required to submit the same or new development plan modification for City <br /> approval prior to development of the site in the event that the applicant fails to have <br /> approved a tentative parcel map within two years of PUD approval, or apply for an <br /> extension of the PUD approval prior to the date of expiration. After the tentative parcel <br /> map is approved, the expiration of the PUD development plan modification shall coincide <br /> with the expiration of the tentative parcel map and any extensions of the tentative parcel <br /> map approval thereafter. <br /> 6. The development of the property covered by this approval would fall under the "First <br /> Come- First Serve" category of the City's Growth Management program, otherwise <br /> revised. This statement shall be reflected in the design guidelines. <br /> 7. The development covered by this approval may be constructed in two phases, the first <br /> phase shall include private and public infrastructure including streets, utilities, etc., and <br /> the second phase will include the homes by a single applicant or by separate applicants. <br /> The two construction phases may overlap each other. The proposed phasing and <br /> explanatory narrative shall be depicted on the tentative parcel map. <br /> 2 <br />
