The CC &Rs covering Lots 1 through 4 shall include the statement, "All private on- site storm drains shall be cleaned by the property owner at least twice a year with one cleaning immediately prior to the rainy season." f. The vegetated bio- retention swales on Lots 1 through 4 shall be mowed and the clippings removed on a regular basis by the Property Owner. The CC &Rs and the design guidelines covering Lots 1 through 4 shall include the above statements in their wording. Parcel Map 92. With the parcel map, the applicant shall set forth the maintenance areas and responsibilities of the proposed development. The applicant shall record CC &R's at the time of recordation of the parcel map, which shall create a Maintenance Association (MA) for the development. The CC &R's shall be subject to the review and approval of the City Attorney prior to recordation of the parcel map. The MA shall be responsible for the maintenance of all private streets, storm drain system, utilities, wildland fire and buffer areas, and other common areas /facilities on the site. The City shall be granted the rights and remedies of the association, but not the obligation, to enforce the maintenance responsibilities of the property owners association. 93. The applicant shall show the building envelopes on a reference sheet to the parcel map. This reference sheet shall be recorded with the parcel map. 94. The recorded deed of sale for all lots covered by this PUD Development Plan approval shall include the following: The following statement, signed by the future homeowner, stating that, "You are hereby advised that this property is surrounded by land zoned and /or used for the day and night -time activity relating to livestock grazing and the keeping of livestock. Some of the impacts associated with this use include, but are not limited to, noise, odor, dust, chemicals, refuse, waste, unsightliness, use of agricultural equipment, and traffic. Permitted agricultural pursuits conducted in accordance with good practice and maintenance is not deemed by the City of Pleasanton to be a nuisance." Wording for this disclosure shall be submitted to the City Attorney for review and approval before approval of the parcel map for this development and shall be recorded over the project site by separate instrument. 95. With recordation of the parcel map, the applicant shall abandon all access rights to Foothill Road to the City of Pleasanton. 24
