EXHIBIT "A" <br /> Case PUD-83-17 <br /> <br />1. That the development shall be as shown on the development <br /> plan, Exhibit A, on file with the Planning Division exceDt <br /> that the numbers of units shall be reduced from 46 to 40 <br /> and this reduction shall be accomplished by converting the <br /> six-plexon the northwest corner o~ the property to a four-plex <br /> and the eight-plex on the southwest corner of the site to a <br /> four-plex. <br /> <br />2. That prior to issuance of a building permit, plans for <br /> all fencing on the site shall be submitted to the Planning <br /> Division for aDproval. In addition to the fencing shown <br /> on the development plan, a minimum 6 ft. high solid wooden <br /> fence shall be constructed along the entire length of <br /> the western property line of the subject property, exclusive <br /> of the setback and a minimum 6 ft. high masonry fence shall be <br /> constructed alon~ the entire eastern property line exclusive <br /> of setback. This fence shall be installed and terraced from <br /> the lowest point on the ~roperty adjoining the Mavis Street <br /> residences. <br /> <br />3o That no parking shall be allowed on the south side of <br /> Vineyard Avenue in front of the subject property in order <br /> to allow proper ingress and egress to the subject site. <br /> <br />4. That the property shall be subdivided for sale and condominium <br /> purposes prior to issuance of a building Dermit. <br /> <br />5. That prior to the filing of a final mad on the subject <br /> property, CC&Rs shall be aDproved by the City Attorney; <br /> these CC&Rs shall provide for a proDerty owners association <br /> with sufficient power to manage all commonly owned areas. <br /> The City shall be named as third party beneficiary of said <br /> CC&Rs and shall be granted the power to enforce its provisions <br /> if the property owners association fails to do so. The Mavis <br /> Street residents shall have the opportunity to have input into <br /> the preparation of the CC&Rs. <br /> <br />6. That the interior streets within this development be Drivate <br /> and maintained by the homeowners' association. <br /> <br />7. That a curb to curb public service easement be granted over <br /> the interior streets. <br /> <br />8. That the water and sanitary sewer systems be public and <br /> be within the P.S.E. <br /> <br />9.
