03 <br /> ORDINANCE NO. 2002 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING SEWER RATES, FEES AND CHARGES AND AMENDING SECTION <br /> 15.20.180 OF THE MUNICIPAL CODE TO PLACE THESE IN THE MASTER FEE <br /> SCHEDULE <br /> WHEREAS, the fees, rates and charges for providing sanitary sewer services are <br /> required to provide for the recovery of all local and regional costs incurred by the City, Dublin <br /> San Ramon Services District (DSRSD), and City of Livermore in providing such sewerage <br /> services, including capital, operational, maintenance, administration, maintenance, monitoring <br /> and replacements costs pursuant to Municipal Code 15.20.30; and <br /> WHEREAS, fees, rates, and charges are to be increased or decreased annually, on an <br /> automatic basis, without requirement for further City Council action based on: (a) the change in <br /> the Consumer Price Index (CPI) as applied to local sewer rates and charges imposed by the <br /> City, beginning July 1, 2011; and (b) the change in regional treatment rates charged to the City <br /> by DSRSD and the City of Livermore, beginning July 15, 2010; for the next five (5) years, upon <br /> notice provided to customers as required by law; and <br /> WHEREAS, as provided in the City's existing contract with DSRSD, the City is required <br /> to charge customers based on DSRSD's rates and Customer Classifications where DSRSD <br /> has recently advised the City of a misclassification of townhouses; and <br /> WHEREAS, discounts for persons over the age of 62, and qualified low- income persons, <br /> must be modified to reduce the cost to the General Fund and better serve qualified low- income <br /> and fixed income seniors and other persons by raising qualifying age to 65 for senior discounts <br /> (while allowing only those already receiving the discount at age 62 to continue); and <br /> WHEREAS, the fees, rates and charges would also be removed from Section 15.20.180 <br /> of the Municipal Code and instead be in the Master Fee Schedule for ease of access by the <br /> business community and members of the public. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. The Sewer Rates and Charges are amended as provided in Exhibit A, <br /> attached and incorporated by reference; and shall be set forth in the Master Fee Schedule <br /> (Resolution No 92 -100). <br /> Section 2. Section 15.20.180 of the Municipal Code is amended to read as follows: <br /> 15.20.180 Schedule of Rates, Fees and Charges. <br /> Sewer rates, fees and charges shall be in accordance with the <br /> amounts specified in the master fee schedule. <br /> Section 3. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in "The Valley Times," a newspaper of general circulation published in <br /> the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the <br /> City Clerk's office within fifteen (15) days after its adoption. <br />
