Exhibit 1 <br /> Sections: <br /> 5.36.010 Established. <br /> 5.36.020 Boundaries. <br /> 5.36.030 Amendments to state law. <br /> 5.36.040 Purpose. <br /> 5.36.050 Assessments. <br /> 5.36.060 Benefit. <br /> 5.36.070 Power to contract. <br /> 5.36.080 Collection of assessments. <br /> 5.36.090 Bonds. <br /> 5.36.100 Prior Action. <br /> 5.36.010 Established. <br /> There is established in the cities of Pleasanton, Livermore, San Ramon and Dublin, and <br /> the Town of Danville, the Tri- Valley Tourism Business Improvement district "the district under <br /> the provisions of the Property and Business Improvement District Law of 1994, as set forth in <br /> the Streets and Highways Code of the state, Section 36600 et seq. <br /> 5.36.020 Boundaries. <br /> The boundaries of the district shall be the corporate limits of the cities of Pleasanton, <br /> Livermore, San Ramon and Dublin, and the Town of Danville, as such corporate limits are <br /> amended from time to time. <br /> 5.36.030 Amendments to state law. <br /> The businesses and operation of the district shall be subject to any amendments to the <br /> Property and Business Improvement District Law of 1994, as amended. <br /> 5.36.040 Purpose. <br /> The purposes for which the assessments collected under this chapter shall be used are the <br /> statutory purposes set forth in Section 36600 et seq., of the Streets and Highways Code of the <br /> state, or one or more of the following purposes: <br /> A. Sales and marketing programs and activities designed to attract overnight groups. <br /> B. Communications and public relations activities and services to build greater <br /> awareness of Tri Valley businesses and the Tri Valley region as a tourism, meeting, and event <br /> destination. <br /> C. Administrative costs and operation. <br /> The improvements and activities to be provided in the district will be funded by the levy of <br /> the assessments. The revenue from the levy of assessments within the district shall not be <br /> used to provide services outside of the district, or for any purpose other than the purposes <br /> established herein and in the Resolution of Intention. <br /> 5.36.050 Assessments. <br /> All lodging businesses with 35 or more rooms available for public occupancy within the <br /> boundaries of the district shall be subject to an assessment based upon $2.00 per paid <br /> occupied room per night, with a possible annual increase in the assessment of up to $0.10 in <br /> each of years four and five. Stays by persons who are government employees on government <br /> business, and stays of 30 days or more shall not be assessed. <br />
